tengo un hijo de mi prometido

Hola a todo el foro, mi novio y yo tenemos un hijo de año 5 meses, la pregunta es? que paso debemos seguir con el bebe, porque no creo que lo correcto sea que nuestro hijo se neneficie con la k2, mi novio reconocio legalmente al bebe aqui en mi pais, pero ahora que el es ciudadano y empezara el proceso de la visa k1 (porque dice que es mas rapida y ya no queremos estar separados), tenemos esa duda , como procedemos alguien me ayuda????? :unsure:

Su hijo es un ciudadano de los EU...consiga una pasaporte al consulado de los EU. No necesita un visado tipo K-1.

I finally got rid of the never ending money drain. I called the plumber, and got the problem fixed. I wish her the best.

Es sino que su novio vaya a la embajada de EE.UU. en Managua y presente el certificado de nacimiento de él o pasaporte para comprobar que es ciudadano americano, con el certificado de nacimiento del niño. Allá le darán el pasaporte americano al bebé al igual que el # del seguro social.

Gracias , y en eso estabamos pensando, en que mi novio viniera a mi pais, y presentara el certificado del bebe, antes de empezar el proceso de la visa k1, aunque sera problema que el recientemente sea ciudadano, y que el bebe haya nacido cuando el era residente? no hay alguna restriccion? :star:

Al principio, pensé que esta sería la ruta para que el niño obtenga la ciudadanía a través del padre, pero al igual que jokalu, me queda duda si el hecho que la adquisición de la Ciudadanía del padre es posterior al nacimiento del niño tiene algún efecto y hace que en lugar de aplicar a un pasaporte americano en la Embajada tengan que hacer un Application for Citizenship and Issuance of Certificate Under Section 322 (Form N-600K), establecido en el Child Citizenship Act .

The Child Citizenship Act, which became effective on February 27, 2001,amended the Immigration and Nationality Act (INA) to provide U.S. citizenship to certain foreign-born children-including adopted children-of U.S. citizens. Specifically, these children include:
  • Orphans with a full and final adoption abroad or adoption finalized in the U.S.,
  • Biological or legitimated children,
  • Certain children born out of wedlock to a mother who naturalizes, and
  • Adopted children meeting the two-year custody requirement.
This legislation represents a significant and important change in the nationality laws of the United States. The changes made by the CCA authorize the automatic acquisition of citizenship and permanently protect the adopted children of U.S. citizens from deportation.

In general, children who are younger than 18 years of age and have at least one parent who is a U.S. citizen whether by birth or naturalization will benefit from this new law. Under the CCA, qualifying children who immigrate to the United States with a U.S. citizen parent automatically acquire U.S. citizenship upon entry; children who live abroad acquire citizenship on approval of an application and the taking of the oath of allegiance.

Tomando, en cuenta también que el bebé vive abroad, y que el papá adquirió la ciudadanía posteriormente al nacimiento del niño. Yo entiendo que lo procedente es seguir esta segunda opción.

Qué opinan ustedes? Yo aún tengo dudas... creo que sería interesante hacer la pregunta en el forum general para obtener más respuestas.

PS: La Embajada de U.S. en Guatemala está en la Ciudad de Guatemala / La Embajada de U.S. en Nicaragua está en Managua ;)
