If i continue I-130 processing.. can she Interview in the US?

Hi,

Since both my Petitions are at the NVC and they have both been assigned Case Numbers, I was thinking of pursuing both cases. My K3 papers were sent to the Mumbai Embassy today.. and I expect to get requests soon for the NVC processing of the I-130.

If I do choose to pursue both, and my Wife arrives in the US before NVC is done with I-130 (which is likely going to happen since it takes about 3 months at NVC), can we ask NVC to hold the I-130 here and can she interview here for an Immigrant Visa?

I want to do the K-3 cuz its about 3 months faster, but I also don't want to pay AOS fee. I was hoping she can get here on K-3 and interview here for the IR-1 and get her green card... is this even possible?

Visas are used to enter a country. You cannot interview inside the US for a visa to enter the US.

Not possible. If your wife can get a tourist visa in the interim, she would have to go back to India to interview. It is in India that the visa will be issued.

Also, it is possible the NVC will deny a tourist visa application if they are aware an immigration visa petition is being currently worked on. Many people try to come to USA on tourist visa and think they can just switch the processing to immigrant here and get their immigrant visas here. The NVC does not allow this.

NVC has nothing to do with whether a tourist visa is issued. The Consulate in the visitor's country issues visitor visas and the CBP (Customs and Border Control) decides whether to allow entry using the visa.

Hi All,

I have a question about what to do with the situation of having two NVC case #'s, one for I-130 & one for I-129F. I know that the packet was sent to Guangzhou Consulate two days ago. I wanted to use the James' shortcut to submit the DS-230 and DS-3032 to NVC. I also talked to the operator at NVC and she said I could process both case #'s but I would have to pay twice for this. She also said not to sub,it any docs until the my wife recieves the packet so this way we would know what docs to submit.

I just want to have my wife here with me the fastest way possible. Which is the best apporach to do this? Use James' shortcuts and submit docs early for the I-129F case # or the I-130 case # or both? should I use the NVC operators advice and wait until my wife gets the packet from Guangzhou Consulate?

If speed is your priority, I would ignore the I-130 and wait for the P3 from Guangzhou.
