Yes, he can try. I know about several instances like this and they all were not issued visitor visas. They were told they are already in immigration process and soon will have their interview.

I meet a girl when I was doing my medical in Belgrade and she told me that she was ask for tourist visa twice while she was in the proces and they said no. I am not shore why. That was last year. She is in US now and that did not cause any troubles later.

So, he can trie but with no to much hope.

It is hard, belive me I know that, but you must have patiens and one day you and your husband will be together and you will forget all the problems and troubles you have now.

When I was in Peru last year I asked US embassy the same question and they told me my husband can apply for tourist visa, but is going to take the same amount of time like I-130 petiton be approved. Every country is different why dont he go and ask/apply.
