It shouldn't affect your interview.

However, I have heard some 8 month pregnant fiance's (129F) being told at the time of the interview to wait until the baby is born. I guess on a fiance visa, if the fiance comes to the USA decided not to marry the USC and yet had a baby in USA, the foreign fiance would not be required to leave the country (since the baby is a US citizen).

Congratulations! It won't affect your process. But let them know during the medical exam. Looks like, you are in the early stage of the pregnancy. Let the Embassy/Consulate know, take a pregnancy report with you for the interview. Most airlines don't allow a more than 28-week pregnant women for long haul flights, but few allow (British Airways is one) upto 36-week for normal pregnancy.

It took 92 days for I-130 to get approved from the filing date

NVC Process of I-130:

It took 78 days to complete the NVC process

Interview Process at The U.S. Embassy

Interview took 223 days from the I-130 filing date. Immigrant Visa was issued right after the interview

We are in the same boat.

'cept my wife is 21 weeks now. We are making plans to have the baby in Japan unfortunately.

We'd rather have the baby in America.

Recieved NOA1...........Febuary 13th 2008

Received NOA2 approval email........May 1st 2008

NVC

May 6th 2008 : NVC received & case# generated

May 15th 2008 : NVC generated & mailed DS 3032 & AOS Fee Bill

May 28th 2008 : DS 3032 Sent (E-mailed / Auto Response)

June 4th 2008 : AOS shows PAID on website, THEN REJECTED twice

June 11th 2008 : AOS bill finally accepted. Shows PAID on website.

June 25th 2008 : Paid $400.00 IV Bill

June 26th 2008 : IV Bill shows PAID on website.

June 30th 2008 : Mailed DS-230 package to NVC.

July 11th 2008 : Called NVC. Automated message stated CASE COMPLETE!

August 8th 2008: Called NVC and spoke with operator. She stated Sept 29th at 9am is when the interview is scheduled for.

Sept 29th 2008: Wife had interview. Medical exam was about to expire before our flight so we had to get another one. Mailed it in to the embassy and got wife's visa a few days later in the mail.

Oct. 20th 2008: Wife, daughter and myself arrive back in America. POE took a whole 10 or 15 minutes.

Oct. 21st - forever: Happy to be with my wife and baby girl.

Wrong. The BABY would not be required to leave the US in your hypothetical situation, but the alien parent would. Being the parent of a USC baby doesn't allow someone to stay. After the baby turns 21, assuming the laws don't change in the meantime, the baby might choose to petition for the parent, but the parent would have to meet all the typical admissibility requirements. And that would include normal overstay issues. Even if the parent managed to overstay a K-1 visa for 21 years without being caught, she/he would still be unable to adjust status, because a K-1 visa entrant is ONLY eligible to adjust status based on a marriage to the original petitioning US Citizen. There's no other way for a K-1 entrant to adjust status. See INA 245(d).

Furthermore, the baby is going to be born a US Citizen regardless of the place of birth, assuming the US Citizen parent has spent at least five years living in the US. Wherever born, the baby will be able to come to the US when he/she wants to, and will be able to petition for his/her parent after the baby turns 21.

You can write to USCIS about yoru wife's pregnancy. You never know, they may approve your petition soon.

Do you mean to my congressman?

You can send it to USCIS where your petition is now. Is it at CSC now? You can also contact your Congressman to see, if he/she can write a letter to USCIS as well. It does not hurt to try. Worse case, they won't do anything and better case, they may approve it sooner. You will need to attach the pregnancy report with your letter. Some airlines allow a pregnant woman upto 36-week (British Airways is one) to fly in long haul flight, if it is a normal pregnancy.
