I'm not sure about this, but I'm kind of ####### about things, I would maybe send those 2 forms again with the checklist in case they tossed them because they weren't with the checklist. You'd think they'd put them with the rest of your file but since they didn't acknowledge the receipt of them it would make me wonder. You'd think they could at least say "hey! We got your forms but where's the checklist"

Just re-read your posting. I don't know what you mean by the birth certificate, but I was adopted as well, and I ordered the long form birth certificate and they sent me it no problem. It has my adoptive parents as showing as my parents (which they are!). There was a letter accompanying it, saying that this is not the actual registered birth, but a later registration due to adoption and that the one registered at birth is sealed and can't be released. I brought the letter with me to my interview, but just handed over a copy of the one they had sent me with my adoptive parents name on it, and not my birth parents name, and no questions were ever asked. You might want to look into this. My parents didn't have to sign anything. Why would they? Records were changed to reflect new parents.

Just in case you were curious, I got the answer from my SO:

"The reason I could not get my long form birth certificate is because apparently

my parents did not sign something when I was born, so the government needs

their allowance to send out the information."

Did you bring your adoption decree with you to the interview?

I don't think Mtl accepts faxes of your packet 3

I know vancouver does and always has

Tell him to send it in asap and write your Mtl case # so they know to put it in the same file

you should also call mtl to ask if you're in the system yet

Did you bring your adoption decree with you to the interview?

No, I did not bring any decree, or any papers actually that pertained to my adoption. I don't remember anything on the checklist that pertained to that either. Unless they're referring to adopted children that beneficiary might be bringing?

I've never heard of your situation, I guess there were some circumstances that makes your case different, like parents that didn't sign anything.

Don't mean to cause you any alarm or confusion!

no, in the packet 3 paper giving details of what you must bring is the adoption decree. I saw it because it is my case too (but mine is a little different since i've been adopted in france and as an adult so i can't say much). The best would be to get the birth certificate anyway then to ask by email at montreal.

Also, i think sending just the checklist is fine, because this is what they ask to do in the letter. Also, you can ask directly to montreal about it.

Carlawarla, I'm glad to hear you didn't need your adoption decree. Though we are working on getting his, it makes me feel a bit better to think it may not be a big deal. Like most everyone else, I just want to be sure we are over-prepared, rather than under! :D

Rae, I'm not sure what is going on with your fiance's birth certificate exactly, but what it SOUNDS like is your attorney is trying to get the birth certificate that was issued before he was adopted. There should also be a birth certificate that was issued after he was adopted, with his adoptive parents' names on it. Depending on the form used by his province (or city or county), there may be some blank spaces. My birth certificate, for example, lists the exact time I was born, my weight at birth, the obstetrician who delivered me, and some of my mom's medical history (previous pregnancies). None of that will be on his birth certificate even if there are spaces for it. But none of it is necessary. The instructions say the birth certificate should include at least the names of both parents (parents = adoptive parents).

I'm not sure what to suggest doing, but I think what you really need is the post-adoption birth certificate. When you filled out all your forms, you must have listed the names of his adoptive parents in spaces for parents' names (because they are his parents!).

If there is some reason THAT birth certificate can't be obtained, then you have to look at what your checklist says to bring in the case of an unobtainable birth certificate.

We actually filled out the online form for the long-form birth certificate ourselves, online. Then they (whoever "they" are) contacted my SO saying some form needed to be signed by his parents. I'm not really sure. But that form is on it's way to his parents to be signed, then back to him, then back to "them", and then they will issue the long form certificate, apparently. With his adopted parents (real parents for sure, as a few of you have pointed out) names on it. So I hope we are on the right track. I really don't understand what the confusion is about either, as no one else seems to have had to do this step... but I guess we'll find out! We're also working on getting a copy of the adoption decree, so I think having that as well will help.

I guess I'll update this when we finally get it in case anyone else has to go through this weird loophole!

Step One: Mail in the forms ASAP

Step Two: Collect the evidence on the check list, check it off the list and then send the check list in when you are ready.

You don't HAVE to mail them all back in together.

The instructions actually tell you to do it the way your lawyer did.

Step One: Mail in the forms ASAP

Step Two: Collect the evidence on the check list, check it off the list and then send the check list in when you are ready.

You don't HAVE to mail them all back in together.

It says so right in the instructions.

I would just send back the check list, you are fine.

Yeah, I reread it and noticed it does say that... but no one on VJ seems to do it that way! And I think it would be an utter waste of time. Wait for all the documents... THEN wait all the extra time for the interview... Don't they know I have a life to get on with?!?! ;)

But thanks. Actually having that pointed out does make me feel a lot less stressed. Yesterday I was under the impression we made a big mistake, but technically we didn't. I just hope we aren't losing any time with the interview...

Okay, I think I misunderstood what you meant when you said his parents had to sign something--I thought you meant the birth parents had to sign something to release information. I don't know why his parents would have to sign something to release his birth certificate to him. This is a pure guess, but it may simply be that some of the information they ask for as a security feature is unapplicable to an adopted child (like the hospital he was born at or his exact time of birth) and the form from his parents takes the place of those questions as a security measure. That is still kind of stupid, though, becuase most kids raised by their biological parents wouldn't know that stuff either. I only know it from seeing it on the long form of my birth certificate!
