SSN and EAD questions

Hi everyone.....

I have a few questions about SSN and EAD, hope you guys can suggest us.

My wife arrived here (California) on Jan 20 by K1 visa and her I-94 was expired on Apr 21. She applied for AOS and EAD on Feb 27 as well as got the Biometrics for both on Mar 14. Yesterday she got the notice for AOS interview on Jun 8 which is pretty faster than we expected but she hasn't got any respond of EAD yet.

1. Do you think that we need to call them now for EAD approval?

At first, we understood that she needs to have her EAD for applying for Driving license and SSN but we just found out that K1 visa holder doesn't need to have EAD for SSN (if I am right). But now her I-94 was expired already since Apr 21.

2. What should we do then? Can she apply for SSN with the expired I-94?

For Driving license

3. Does she need to have work permit only for applying Driving license?

As the AOS interview date will be coming soon, if she doesn't have her SSN, work permit or Driving license in time for the interview....is that gonna be a problem?

05-29-08 : Biometric Notice Date

06-13-08 : Biometric Appointment

08-22-08 : Card Production Ordered!!!

08-29-08 : Greencard arrived

Sure she can apply with an expired I-94, but is going to get a denial letter. SSA-L676 Going to need an EAD card or I-551 stamp or card to be assigned an SSN. Now I don't know what the rules are in CA, but for some states you just need the letter from SSA showing you can't get an SSN to be issued a DL.

The above will not be a problem at all for the interview. If you are approved at the interview, you won't even need the EAD. I'd ask for a passport stamp so that she can apply for SSN right after the interview -- without waiting for the card to arrive.

I suspect she will need the SSN to apply for the driver's license -- you can check on DMV web site or make an appointment at the office to find out for sure.

12-05-2005 Infopass appt at San Jose office for interim EAD -- Refused, because it is already approved by MSC on 11-07-2005

12-07-2005 Attempt at interim EAD at San Francisco office -- no go. Back to San Jose, where CSO (chief station officer) tells they will contact MSC via email to request permission to issue interim EAD

12-08-2005 Biometrics for AOS and EAD. Having no EAD appt letter was no problem (used EAD NOA)

12-15-2005 EAD arrived in the mail

12-24-2005 Received interview letter; interview scheduled 03-01-2006

01-28-2006 Received replacement SSN card in married name (5 wks since application)

03-01-2006 AOS interview -- approved; received stamp in the passport

03-13-2006 Green card arrived in the mail

Claudeth applied two weeks after she got her and then we just changed her name on the card when she got her EAD. The Calif. DMV accepted her EAD as a valid I.D. for getting a Calif I.D. but our bank would only accept the Calif I.D. I guess we don't have much to complain about, others have really had a hard time

But she needs a Govenment issued ID to get into the INS building for the interview, as specified in Notice letter. Is there any other ways for her to get a Govenment issued ID or can she use her foreign passport?

The passport from the home country is a government issued ID -- the ID does not have to be issued by the US government.
