Do I then have to be cleared again. My record did not make me ineligible to travel to the US on a B1 visa, but is applying for a k1 any different? Are the criteria different? Would I have to supply my criminal details agan even though I've been issued a tourist visa? I have looked for this topic on the board, but couldn't find anythingquite the same.

Any help would be much appreciated.

You will have to provide a police record to the embassy that reviews your visa case. Contact the embassy or do more research on the internet for more info regarding whether you will quality with your record.

Can you fill in your timeline and give more details?

12/15/2005 - Sent I-129F to Vermont Service Center

12/17/2005 - VSC receives I-129F via express courier (day 1)

12/23/2005 - VSC officially sends out NOA1 stating receipt

01/05/2006 - Called the National Service Center and got NOA1 receipt number.

01/10/2006 - NOA2 received via USCIS website and email. VSC is blazingly fast! (day 22!)

01/20/2006 - Receive NOA2 via snail mail in Thailand

01/26/2006 - Bangkok Embassy confirms our case is in their system (day 38)

01/30/2006 - Dropped off checklist and doc's with embassy

01/31/2006 - Received email from embassy confirming our interview date 3/20/06! Woohoo! (day 43)

02/08/2006 - Received police report and packet 4

03/01/2006 - Medical Exam completed

03/20/2006 - Interview! (day 91)- SUCCESS!

03/21/2006 - Picked up VISA!

04/04/2006 - Fly to USA together to get officially married in US and to start our life there together!

04/07/2006 - Arrived at JFK, C received temp EAD stamp. Drove to MD to live!

04/20/2006 - Applied for SS Card in maiden name, received it 3 days later

05/12/2006 - Officially married in the US! (2nd ceremony)

05/15/2006 - US Reception

05/16/2006 - Applied for new SS card with married name - Applied for EAD

06/01/2006 - Applied for AOS I-485

10/27/2006 - EAD Approved!

It doesn't matter if you were issued a tourist visa. It's a whole new ball game when you are trying to immigrate.

Well, I had to go through the DHS for the tourist visa, and they didn't make me ineligible to travel to the US, so I can only hope that will be the case this time too. Thanks for the link (although it's broken, I had bookmarked that page before) I don't come under any of those categories so should be OK.

How old is the previous police certificate? Do you still have the original police certificate?

It depends what your previous convictions are. I had two previous ones that I didn't declare on a B1/B2 (down to misreading the form), got the tourist visa, but as a previous poster mentioned the K1 is a completely different ball game.

Your police certificate (which you didn't need for the B1) will list everything that happened in the past, and basically if you have more than 1 conviction or if any of them constitute CIMT, you will need a waiver prepared for the K1 (speaking from experience).

Yes, a K1 visa has some differences in requirements from a B1 visa.

And a B1 visa is not a tourist visa.

It's less than 1 year old so I believe is still valid. I have it and it's also already on file at the embassy.

I was initially made inelligible to travel, but since the conviction (only one I have, although I was also arrested another time but never prosecuted... which I also declared) were not involving moral terpitude the DHS ammended that decision.

And a B1 visa is not a tourist visa.

Oops, my mistake, it's a B1/B2
