Hello, After 1 year of our initial interview may 2007, My wife whom is a Thai resident received her Green card on 3-30-08, but it says it will expire 2010 and we need to file some document to remove her condition status. I would like to know what justified a 2 year versus a 10 year green card?

We married in June 2006 so I am not sure if that is the case or not, but we knew each other for 5 years and she has been in the USA originally on a tourist Visa May of 2006.

Just wanted some feedback if there is something we need to worry about or is this normal practice. We know some friends whom applied the roughly the same time and they got 10 year green card.

Please comment,

Thanks

This is just a test they are doing to see if you guys will last till then, some people have fake marriage so they have to come up with some thing to make the marriage last more than 2 years. Not just coming to USA and get a green card and divorce and go back to get another one. You have to wait for 2 years than apply for another 10 green card. IT is bad for some of us, but hey as long as i am with my wife, i don't care how long it will take.

Good luck :D

wow... do a search to find out the most fundamental basics of this process. Amazing that you made it this far without understanding that you will have to file i751 to remove conditions. Dont mean to sound sarcastic but, very interesting.

This is quite normal. If you have been married for less than 2 years when AOS is approved, you will get a 2 year green card. You will have to file for removal of conditions before the card expires. Once that is approved, she will get a 10 year green card.

You may or may not have to go through the interview process again:-) - how's that for an answer!? Generally, most people don't have to go through an interview, however, USCIS does interview a certain number of cases (ie. 5%) for 'statistical' purposes so there is always the chance of that. Plus, if they do not think your marriage is legitimate due to the nature of the evidence you submit in support of your marriage they may also interview you to try and make their determination. Reading the guides here on the forums is good advice - there is lots of information available. One thing you can do now and continue over the next 2 years is to collect 'evidence' that shows the validity of your marriage - bills addressed to the two of you, opening accounts in both of your names, doing your wills, putting each other on your health insurance, etc. in other words establishng the fact that you have combined your lives together socially and financially. You need to submit this proof with your application to remove conditions in 2 years.

“...Isn't it splendid to think of all the things there are to find out about? It just makes me feel glad to be alive--it's such an interesting world. It wouldn't be half so interesting if we knew all about everything, would it? There'd be no scope for imagination then, would there?”
