Naturalization Question; Over 3 years Married to US Citizen

Hi All,

we are married over 4 Years in 04/2008, When we went for AOS Interview in 02/2005 the officer said I will be Eligible for Citizenship after 3 years and i will be eligible to file the after 2.5 years, but unfortunately My GC got Delayed I have n't got a Temp Gc and I strightaway Got Permanent in 10/2006.My wife is pushing me to file for Citizenship as she thinks I am but to me I am not eligible. Can Some one throw light if i am or not? when I should file I400?

What date does it say on your green card you are a resident from. You can file 90 days before the third anniversary of that date.

Yep, the "resident since" date printed on your card is the important one. When the plastic card came in the mail doesn't matter, nor does when (or if) conditions were removed. The "resident since" date is the date on which you got LPR status.

As long as you've been married to and living with a US Citizen spouse for a full three years, and assuming you meet the other requirements in the M-476 guide to naturalization, you'll be eligible to file for citizenship 90 days before the three year annversary of the "resident since" date printed on your Green Card.
