Who do I contact about cxl'n

Timeline

Some had suggested the Egyptian Military would keep Waleed a few weeks and let him go but it's been a few months and he's in his permanent base now so I accept they are keeping him for his term.

I need to cancel the I-129F because it's pointless now. So who do I contact? The USCIS? The NVC? The consular in Egypt?

When I contact the consular by email they give me canned msgs and don't really answer me.

I need to switch the process to CR-1 or something else that is going to take time since we have till at least March 1, 2009; when he gets out.

What do you all suggest is the best course of action? Where do I start? Does anyone know what I am supposed to do? :help:

Olivia, has your I-129F been approved? Where is your I-129F petition now? If it is at the USCIS (NBC?) before approval, you can write USCIS to cancel it, you can give reasons why you are taking this action. When you write USCIS, you can get a tracking and/or return receipt so that you can find out when they receive your mail.

I-130 Timeline with USCIS:

It took 92 days for I-130 to get approved from the filing date

NVC Process of I-130:

It took 78 days to complete the NVC process

Interview Process at The U.S. Embassy

Interview took 223 days from the I-130 filing date. Immigrant Visa was issued right after the interview

It was approved at USCIS and went to NVC and is now in Cairo waiting for packet three to come and interview appt. which he'll never make because he is serving in the military in Suez City. He was taken last Jan. I'm not really sure who to contact or what is the next step to take. Nobody really plans these things to happen it's just life.

Olivia, you should email embassy about your decision. As usual, explain your reasons in your email. I am sorry to hear your email experience with the Embassy. I also emailed US Embassy in Bangladesh several times and they always replied me within 2-3 days. When you email them, ask them politely to reply you. I hope, they will reply you.

Ok so the best course is to email the embassy to please cancel processing the I-129F as it is no use to us now that the Egyptian Military has taken him and delayed our time.

What course should I do after that? Request from the USCIS to have the I-130 sent to the NVC? Does anyone know about that?

Could you try to have your NOA2 extended by the embassy? Then have him go to the interview later this year and wait for the nearly 6 months to use the visa? Sorry if these are stupid questions, just trying to brainstorm so you don't have to shell out more money!

I assume your I-130 is approved by now and USCIS is holding it, since your I-129F is at the Consulate in Cairo. If that is the case, you can write USCIS (attach the Consulate's email confirmation that your I-129F has been cancelled per your request) to forward your approved petition to NVC. If you submit everything quickly and there is no RFE, you will be able to finish NVC process in about 3 months. Bu again, you can linger NVC process by not submitting the NVC paperwork right away. So you do have any control on NVC process.

Some ppl had suggested that but then they pointed out if I switch to the CR-1 I'll be saving money. By having the I-130 sent to the NVC I pay a fee of around $350 and it's switched to the CR-1 where as if I stay with the K3 then comes the AOS fee of $1010. So if that is correct in the long run I save money.

Yes the I-130 is approved and sitting at the USCIS waiting for the results of the interview and the I-864 paperwork before being sent to the NVC.

So if I get the confirmed cancellation from the consular and no RFE submitted then I can hold that paperwork before resubmitting to the USCIS which will then send the application on to the NVC?

Anyway, yes, write USCIS with your confirmed cancellation from the Cairo Consulate and request USCIS to forward your case to NVC. Right now, NVC requires two fees, $70.00 for affidavit of support and $400.00 for Immigration Visa Fee. NVC might increase the fee, but usully NVC'e fee hiking does not jump that much. As I said, you can linger your NVC process by not submitting the paperwork right away. Even after NVC process, if you need more time, you will be able to request the consulate about it.

Please see prior communication for explanation of the following correspondence.

On January 14, 2008 I received a letter from the National Visa Center with our case number: (our case for the I129F which is scheduled to expire on April 13, 2008.

I would like to request that either the approved I-129F be extended at this time or complete cancellation and we will try out hand with the CR-1. My Husband, (husband's name here), has been serving in the Egyptian Military since Jan. 2008 and this has delayed our visa process which makes the I-129F useless to us now.

Please reply with advice of which course of action the Consular Staff may take.

Thank you for your continuing support,

Looks good. Make sure, you mentioned you and your husband's names and date of births with the case number. Usually Consulate, NVC wants case number on the email's 'subject' line. Good luck.

Aww Olivia just wanted to say I didn't know you were going thru this huge separation. I admire you and you've stayed so strong knowing you won't see him as everyone here is seeing their spouses (sorry if that just made you feel bad lol) Just wanted to say you are so positive in such a situation .
