Hi!

I was wondering if anyone knew the answer to this question.

The USCIS post their processing dates supposedly each month, and as we are all aware the bloody I-130 at Vermont went backwards this month.

Are these processing dates relevant to when you first file your petition to the USCIS and they give you the date they receive it, or when you get NOA-1?

So we filed our I-130 to the USCIS with a date received there of Sept 10th 2007, this would hopefully mean only another month and a bit to wait. Our NOA-1 has a date of Dec 27th, which would mean 5 more months to wait!

So does anyone know which one it is? Hopefully the first one as we have already been in this coming close to 7 months, another 5 months for approval is crazy! And people are now getting approved who filed after us, in a fairly short time.

Hope to hear some ideas soon.

I don't have the answer,but I hope it is the date the application was received.I am right around your time,september 26th,and this wait is unbelieveable , like you,I am wondering,and I am happy for all of us getting our NOA2,but can someone tell me why people are getting approved who filed after my date.some getting approved in a short time frame.

it is not making sense......I mean it took me 4 months to get an NOA1.....How long now for the NOA2?

Hi Jimi.

It sounds like you are in exactly the same boat as me. From what I can read, and the way other people are getting approved I would imagine that it is from the date first filed. This would seem to make sense looking at peoples timelines. I got caught in the receipting backlog and it took me a long time to receive NOA-1 too. But hopefully we are getting there soon. I am definately happy for people receiving NOA-2 but I am also like "Hey, what about us!". I would only draw positives from this though hoping that we will be soon. I have a lawyer doing my paperwork, as I would balls it up royally! I have also asked him my question so when he replies I will post the response. Although hopefully others out there will also know.

Generally it is when they receive the I-130 (priority date). However; everything under the sun can have an effect on when it actually gets approved….not only RFE, but likely what they reviewers had for breakfast.

So hopefully we should be hearing something soon. However, most of those timelines are at CSC so we need VSC to get their ####### in gear and catch up! Thanks for the reply, gives me hope that there is light at the end of this very long tunnel.

I just got an e-mail back from my lawyer and they said that it should be from the date first filed, which for us was September.

Hi Dave, the process is supposed to be 'First In First Out' and based upon the date your file arrived (priority date), and not the date of the NOA1. However, as you can see, of late this has not been the case, and now it's almost anyone's guess as to who will be approved first. A veritable lottery which is most depressing, I too am Vermont, and have been a little stunned by the recent approvals spanning from November filers to February filers .... the willy nilly approvals do not make any sense :wacko:

Maybe there is something strange in the drinking water?? :jest:

By the way, I'm a little Cornish Maid myself.

I only included CSC….but definitely a problem with VSC!! :protest:.. It doesn’t even look like they are looking at VSC September…based on VJrs timelines.

But, who knows for sure…tables could turn at any moment.

Hey! Nice to hear we are setting down more Cornish roots in the US. I am a PE teacher but am wondering if Pennsylvania is ready for the Cornish Pasty if I cant find a PE job. A friend has suggested that I make and sell the Philly Cheesesteak Pasty! Could be a winner. Yeah Vermont is depressing right now but got to look on the positive, sure it will come good soon. I just dont see how they are processing and approving petitions after ours. Oh well!

My guess why USCIS go out of FIFO rule is - some officers are efficient and process their pile of applications faster than the other officers. The second group is kind of drunk and process, so they just see the blur on their eyes while looking into July/Sep 2007 applications :blush:

Well this is good to hear.It's some comfort anyway.........and where the hell is the end of that tunnel ????? Is VSC working?
