Hello everyone.

I was looking ahead into the future time and came to the realization that me and my spouse will be in Germany on military orders at the time of our 90 window to file for permanent residence with the I-751 form. She has a conditional residence green card which is good untill June 2009.

How does this work for those outside the United States on military orders? And at what office do we file?

I'm not sure if or how military status affects filing for conditions. But, if you can't find an answer how about preparing the package before you leave on orders and asking a family member to mail it in for you?

Please call the US Military Immigration Helpline

USCIS has established a toll-free military help line, 1-877-CIS-4MIL (1-877-247-4645), exclusively for members of the military and their families. USCIS customer service specialists are available to answer calls Monday through Friday from 8 a.m. until 4:30 p.m. (CST), excluding federal holidays.

They will give you all the information you need, and are extremely helpful. You will speak with USCIS directly and there will be no 'messing around'.

Once you get your information, can you please post it on the Military Spouses Thread, so that it can help those in your situation in the future.

USCIS has established a toll-free military help line, 1-877-CIS-4MIL (1-877-247-4645), exclusively for members of the military and their families. USCIS customer service specialists are available to answer calls Monday through Friday from 8 a.m. until 4:30 p.m. (CST), excluding federal holidays.

They will give you all the information you need, and are extremely helpful. You will speak with USCIS directly and there will be no 'messing around'.

Once you get your information, can you please post it on the Military Spouses Thread, so that it can help those in your situation in the future.

Your an angel thank you. Thanks to everyone else as well.

Talked to them at USCIS. I was told that we will go ahead and file the I-751. At that point my wife will be issued an paper that will give her temporary green card a one year extension. Upon approval of the I-751 of course. I was also told to send a copy of my orders bringing me to Germany along with the rest of the supporting evidence. At that time the USCIS will make a choice as to if we or just my wife has to travel back state side for an interview.

Does anyone know if the interview process for this is ever waived or is it necessary every time for being granted true permanent residence? Its a pain to have to travel back to the United States upon getting to Germany and I am not sure if my chain of command would allow me to do that. Hopefully the USCIS will work with us.

I am sure I will cooked up more question and give those folks a call.

It is actually quite common for there to be no interview, and I am sure USCIS would not make you do something that the US Military didn't want you to, so don't worry on that end :)

25 May 2007 - NOA2

2 June 2007 - Received Packet 3

12 Oct 2007 - Sent Packet 3 back by special delivery

5 Nov 2007 - Interview in London - Approved without any hitches!

7 Nov 2007 - Visa and MBE arrived by SMS! :)

30 Jan 2008 - Fly to Michigan!! :)

*Note: Any delays in our case are only due to us taking things slowly

It is actually quite common for there to be no interview, and I am sure USCIS would not make you do something that the US Military didn't want you to, so don't worry on that end :)

Sure hope so. I will send them a mound of supporting evidence of our outstanding relationship so there should be no doubts in their eyes anyways. That would be awesome if they were so understanding of our situation. Thanks for the fast reply.

I have lodged a I-751 from germany,.completed, and have a 10yr g/c to show for it,....any questions just ask,..

The timeline... (Frankfurt) for the kids visas

10/22/2007 Filed I-130 x 2 in person + paid 710 USD (355 each )

10/22/2007 Filed DS-230 part 1 x 2

10/22/2007 Received the document checklist and FRN (case) numbers

12/18/2007 I-130 petition approved, but I didn't know. I was away at the time, didn't get confirmation letters til I got back from the states.

12/20/2007 Notice of Approval arrives in tha mail. According to the date received stamp on back of envelope at my post box.

Will now wait til hubby is back from Iraq to fax in checklist readiness, even though, I have been ready since day of lodging I-130's. all except medical.

02/18/2008 Faxed the "checklist" back to the consulate.

02/25/2008 Medicals completed.

02/25/2008 Appt letters in mail for appt on March 7th. Cant go due to prior military commitments. Emailed consulate and received an amended appt date of March 12th 2008.

03/12/2008 Visa interview - APPROVED x 2

03/27/2008 Visa's finally generated. I emailed the consulate. they apologised for the delay. They forgot to issue the visas after approval.

03/31/2008 Received visas

04/26/2008 Flying out of Frankfurt to next duty station on orders.

LOL, I was just about to follow up with you as your name was mentioned above. Congrats by the way. Did you have to do an interview for this or was just the paper work necessary? I was just told that the interview is not always necessary.

I am currently in Germany and I am about to file for removal of conditions this June. I had to fill out an AR-11 and I865 to inform USCIS of our new duty station. Then come filing time, I will send my I751 paperwork from here and use my APO address as mailing address. Fingerprinting can be done in any military installation, U.S. Embassy or consulates here in GE. We provide our own passport pictures too. For military dependents assigned overseas, we are not required to go back to the U.S. for biometrics. But then there's still a possibility we might go back Stateside for an interview. But most get approved without interview! If you have any questions, you can also PM me. Take Care!

No interview required, and as Catie said, Fingerprints (biometrics) are now taken either on base, or at the US embassy also now in Germany. Back when i did mine, they did not have the option to do the fingerprints here, I had to fly back to the States for it,..But, I was flying back for Christmas anyways, at the time, so it was no big deal.

Just be aware, that, they do randomly just select people for interview, but the chances that you will are highly unlikely. I think the fact you are military helps a lot with that. If you are unlucky enough for your wife to be selected for interview, she can attend on her own, ifyou are deployed. Thats what i had to do with my AOS interview at the time. Just had to have a letter from my hubbus command, and a copy of deployment orders.
