MY USC FIANCE WAS WORKING BEFORE DECEMBER 2005 WITH AN ANNUALLY INCOME OF 25K PLUS,

BUT LOST HER JOB TILL APRIL 206, SHE BEING UNEMPLOYED SINCE APRIL 2006 ,BUT SHE GOT A NEW JOB OF 27K ANUALLY

AND SHE IS TO START THE JOB ON 24TH MAY 2006 AND MY K-1 INTERVIEW IS ON THE 25TH MAY 2006.

CAN SHE ALONE, STAND FOR ME AS THE ONLY SPONSOR, WITHOUT A CO-SPONSOR?

Just to let you know. Co sponsers for K1 visas have been denied at Lagos. There are several here that have been denied a K1 visa for that reason. However, from what you have explained here...if she is employed and is over 125% of the poverty line for the past three years, then you shouldnt have a problem. I believe 25,000 is well above the poverty guidelines for a single person, but amount of children/dependants she may have will be a factor. Not having a job for a month or so should be irrellavent, as long as she is still above the yearly poverty guidelines. Check out the guides here for more specific information.

I think its probably best to ask her to ask her new supervisor to write in a letter that she is employed and when she will be starting. If the employer can mention that it is a permanent position and the pay rate, I think that will help your case. Plus like joej said, her history of having adequate income may help as well. My usc fiance has no dependant at all.

And her current pay is 27 k for her alone.

But,can't the mother just act as co-sponsor?

the mum earns up to 90k and has no dependant at all.

my usc fiance just acquired a home were she pays

mortage of up to 1200k monthly even when she has no job

so there, can she include the property in the affidavit of support.

Lagos does not accept co-sponsors for k-3 and k-1. I was denied for that as a k-3 and Khanjamil another VJ member was denied as a k-1.

Since your chances of being approved in Lagos with a Co-Sponser (K visas) are small, I think your best option is to do like S&S suggested and get a letter from your fiance's new employer. Adding her assetts will also boost your case.

Also it is my understanding that they will not inform you of the denial untill you go for the interview, so even if the NVC and or consulate initially accepts the paperwork for a co-sponser, you will most likely be denied once you go to the Consulate for the interview. Someone please correct me if I'm wrong.

According to the information on the following USCIS link, your spouse must submit evidence of "current" employment. In this case, assetts are irrelavent. I have pasted these paragraphs below. Since she doesnt have the job yet, but anticipates to get it, I would suggest that you consider delaying the apointment a few weeks. It would be better than getting a denial. Also, you may already know the reputation of the US consulate in Lagos. They deny many people for smaller things. Getting a visa there is very difficult.

My usc fiance has no dependant at all.

And her current pay is 27 k for her alone.

But,can't the mother just act as co-sponsor?

the mum earns up to 90k and has no dependant at all.

my usc fiance just acquired a home were she pays

mortage of up to 1200k monthly even when she has no job

so there, can she include the property in the affidavit of support.

when my husband went for his k1 interview at Lagos embassy, i had just changed jobs. We did use a co-sponsor and it was accepted for my hubby. I think u guys should also take into consideration that maybe having her mom as a co-sponsor would definitely help the case along as well as getting a letter from her new employer on company letterhead stating her new job, salary, and whether or not is a permanent position. Hope this helps u.

Since your chances of being approved in Lagos with a Co-Sponser (K visas) are small, I think your best option is to do like S&S suggested and get a letter from your fiance's new employer. Adding her assetts will also boost your case.

Also it is my understanding that they will not inform you of the denial untill you go for the interview, so even if the NVC and or consulate initially accepts the paperwork for a co-sponser, you will most likely be denied once you go to the Consulate for the interview. Someone please correct me if I'm wrong.

NVC? I thought that you bring the co-sponsor information at the interview? Correct me if I'm wrong...

I am a living withness to the K visa affidavit of support which is the I-134. Since ur wife already has a job in line just tell her to get a letter from them that state she will be emplyoed at the date U told us. Get her three years income tax ready and don't even bother to get a co-sponsor cos they won't accept that from U in the Lagos consulate, U will give them a chance to deny U the visa of U do. U have to show them that U're confident of what U have. If U meet the male consular officers, U won't have any problem at all becos they ain't as difficult as the female consular officers, especially the slim white lady in window 6. The affidavit for k visa is not the same thing like the I-1864 affidavit of support and people should understand this. I prove this during my interview cos my wife then was earning below 125% but above the 100%. All they want to know is that ur wife is working and can take care of U before U get a job of ur own.

Since U don't have kids and so also ur wife doesn't have kids I see U not having a problem. Just go with confidence with what I told U to get and make sure the employer of ur wife state out in the employment letter that she is goin to be permanent with them. I hope have been able to add my 1 cent to this.

Interview date: 19th January 2006 DENIED (221G)

Second interview: 3rd of Feb 2006 VISA APPROVED! Thank U Lord!!!

since she has been working for the past 4 and 1/2 yrs and making up to 25k anaully with her 3 yrs tax

clearance,letter from her current employer and we will be fine.
