Really need a help on I-130 or I-129F ????

Hi everyone on VJ….I really need some help on my case….My I-130 was approved on 3/20 and I received my NOA2 approval notice in the mail on 3/24…. The NOA2 says that my wife is here in the U.S. and will be adjusting status HERE. However, this is not true. I clearly mention on my I-130 form that she would be adjusting status in India because she is in the India and she cannot adjust her status here. The NOA2 says to submit I-824 to have her case transferred to the NVC or else they will send it to the local office…I also file for I-129F and USCIS need some additional evidence or information in this case I129F PETITION FOR FIANCE….but I have not received mail from USCIS, I have been waiting for more than a week….now I don’t know what to do should I file I-824 or wait to get approval on I -129F ….Please please help me on this subject…Thank you very much :help: :help: :help:

Ita better to call USCIS and clear the matter. You may have given the wrong address on G325 for ur wife check ur copy.

This generally means that they have approved both your I-130 & I-129F petitions. As described in the press release, they forward the approved I-129F to NVC and hold back the approved I-130 at NRC. They expect you to bring your spouse here on K3 visa and then adjust the status here, and hence the wording on I-130 NOA2. Check the I-129F receipt number on USCIS case online, and chances are you will see that it is approved; just the mail might have been delayed. If you want to bring your spouse on K3 visa, you have to do nothing. If you want to bring on CR1/IR1 visa, you have to submit I-824 to make them forward your approved I-130 to NVC.

Either way, congratulations!!! :thumbs:

My I-129F it has not been approve yet....USCIS need some additional evidence or information in this case I129F PETITION FOR FIANCE….but I have not received mail from USCIS, I have been waiting for more than a week…I really don't know what USCIS needs from me???? Thanks tho... :help:

Sorry, I did not catch that last part. I would think that if you called the RFE line, they will tell you what exactly do they need. Good luck!
