Greetings everyone. It seems as though VSC is really taking endless months processing I-130s...looking at the timelines of K-1 and K-3s, I was wondering if anyone had any thoughts on sending in a K-3 application instead of waiting for the IR/CR-1 because my husband travels a lot in Europe and we didn't want him to be here long without being able to work and travel...spending the additional money for AOS...but I was just wondering if anyone had any ideas, suggestions or thoughts on the matter. I'm not sure that we can wait until the end of this year or next year to live together. It's depressing us both after just losing our unborn child. Thanks for any answers that you provide.

I don't think the K-3s are really moving much faster through USCIS at this point. They do however, only take about 1 month at NVC compared to 3 months for CR-1/IR-1. Interview times for the two can vary widely, so I would suggest checking your regional forum to determine the Embassy/Consulate time lines for the two different visa types.

My opinion, is the end result is on a K-3 he will be in the U.S. faster, but he probably won't be back at work faster. It really depends on your priorities.

I don't know about K3s moving faster but to apply you would only need to send in the I12F form along with your G325s, photos, supporting docs ect. Basically the same information that you sent with the I130. The fee is waived for the I129 if you have the I130 on file so send a copy of your NOA1. Then you can see which is approved first, the I130 or the I129. I don't think applying for the K3 will hurt anything ....

You do not get to choose after seeing which petitions is approved first. It used to be that you could let both petitions run but that stopped in November, 2006.

If you want an immigrant visa, don't file an I-129F.

as long as you are in the US faster and back to work "NOT later" than with CR-1, I think it is worth it!
