In filing 485 you need marriage certificate and you only 90 days for K1 visa.

Some people chose to file right after they got the certificate since it will take 3-6 months in receiving the GC. Others chose to wait awhile. It really depends on the 2 of you. God bless on your journey together.

Thank you kindly..

I plan to file soon.. I just was wondering if I had to do it with in the 90 days.. I just haven't found any requirements on filing.

You have 90 days to get married from the day she arrives here ( or as stamped on her I-94) . However, for the Adjustment of Status ( I485) there seems to be no clear deadline. As long as you get married, she is safe to stay here after the 90 day period. The reason why many file the AOS right after marriage is for the alien wife/husband to get the green card for them to have the resident status. I know a lot of couples who took their time before filing and it was okay.

Removal of Conditions :

August 16, 2010 - Petition received by USCIS Vermont Center

August 20, 2010 - NOA1 received

October 4, 2010 - Biometrics

January 3, 2011 - Permanent 10 yr. Green Card Received.

In order to work you will want to file I-765 for EAD along with the I-485, filing for EAD with AOS costs nothing extra, it is included in the AOS fee. Can work with EAD or Green-card which ever comes first.

K-1s should NOT file I-765 before filing the I-485 because the EAD that results is a 90 day one that expires 90 days after arrival, and costs $340. EAD can take 90 days or more to get.

I have not really read this one, thanks for the link. My cousin has been married to her USC fiance last December 22, she arrived here November 24. Until now, they have not filed their AOS yet and Bob, her husband actually called the USCIS and they told him that she is okay as long as they got married within the 90 day period. I really dont know the reason why he is delaying the AOS filing, Ive been pushing my cousin to kind of push her husband to do it but because of the information he obtained from USCIS, he is not worried about it. Im sure its not about money because he is financially stable. I will send this link to her.

By the way, my Biometrics was March 18, 2008 and when my husband and I arrived from Texas yesterday, March 29, my EAD card was already waiting for me.
