Document verification for someone previously married...

Timeline

my fiancee was married before...she is now annulled...for whatever reason, the embassy has her records on file in her married name. now, she wants to do the document verification, but neither of us knows if she should use the name they are using for the file, or her unmarried name.

my opinion is that she should use her unmarried name, since the prior name was annulled and no longer exists...but she is freaking out about this. i also said they have both names on record, and it shouldnt be a problem....but she wants me to post about it here, and see if anyone has had a similar experience.

If I am understanding your question correctly, it is the US Embassy who will decide if you need your documents verified. If she is wanting to pay for document verification she would use the name on the I-129F petition and your MNL2008 case number. The doc verification is for NSO documents.

If your fiancee was married and annulled in the Philippines, then more than the divorce decree is needed. Someone can explain the documents needed better than I.

Just out of curiousity, what surname did she use when you filed your I-129? When you say the USEM has her records on file, I have to presume that its the I-129 file plus your supporting documents filed before the USCIS here.

Removal of Conditions :

August 16, 2010 - Petition received by USCIS Vermont Center

August 20, 2010 - NOA1 received

October 4, 2010 - Biometrics

January 3, 2011 - Permanent 10 yr. Green Card Received.

Same here.I got annulled too. I used my maiden name when we filed i-129 and when I got my passport and NBI clearance. One of the VJers whom I met online had used her married name when they filed because her passport and any other identifications she had were on her married name but she had her annulment decree submitted to prove that prior marriage was terminated. She did not have any problems at all or delays from the US embassy. She arrive in the US 5 days after her interview.

05/29/07 sent I-130s for me & my daughter at CSC

06/16/07 checks for I-130 cashed

06/19/07 sent I-129F not waiting for noa1 but with printed online copies of checks cashed

06/25/07 check for I-129f cashed

06/29/07 transferred I-129f to CSC

07/03/07 received noa1 in the mail for I-129f

10/31/07 approved K3 and my I-130 except for my daughter

11/05/07 received NOA2 in the mail

That seems a bit funny. I was going to say that it would probably be best if you just continued to be consistant with the same name you have used throughout the 129-F process. Then, if they have any questions at the embassy, you will have your BC and your annullment decree and can simply explain the situation.

But how is it possible that the Case Number letter is listed under your married name, when you created the I-129F package using your maiden name? That seems odd to me...
