What happens with foreign fiance's passport?

Timeline

Should my fiance renew her passport before she comes to u.s.? Her passport expires in 2009, will she still have to use this passport after we are married? Or does something replace this for her to travel?

I think what he was refering to was was whether or not, once his foreign finace marrys him (the us citizen) and then her non US passport expires, will she then have to travel on a renew/ reissued foreign passport, or can she apply for an american passport.

Just found out the following information:

Your foreign wife does not need to get US cistizenship if she does not want to. I believe she needs to wait 3 years before she can apply for US citizenship. Until she is approved for citizenship is are still considered an citizen of her coutry and need to travel on that passport.

Once she gets her conditional greencard (when the AOS is granted), she will then need to carry that with her when she travels outside the US.

She will still be traveling on her countrys passport (NON US PASSPORT) and will need to get visas for countries that require them (as stipulated by her coutry, not the USA).

90 days before your conditional greencard expires (on the 2 year anniversay of the AOS being granted) she will need to apply to remove the conditions on your greencard (in the two years she will be on a "conditional green card).

When she gets approved for that she will get a 10 year greencard.

In the third year of being married to you, she can apply for US citizenship and thus a US passport.

So to answer your question, yes, she should renew her passport, but it doesnt matter if she does it now, or when it expires, as she will have a conditional greencard--that is the form of VISA evidence not the passport.

yes, eveybody needs a passport to travel! getting a green card does not mean youre a us citizen and get a us passport. you can file for naturalization after holding your gc for 3 years but before that youre still a citizen of your home country and have to hold the corresponding passport.

another thing, when youre fiance wants to enter the us she will need a passport that is valid for at least another 6 months from the day of entry!

Do you happen to know when we are married if we we get treated the same when we travel over seas? Or do I have to do a visa for her when it's not required for me. She is Vietnamese so she has to have visa for travel anywhere I only want to know if that will changed after we are married and she get a temp greencard?

For the most part being a LPR of the USA allows her travel into Canada and Mexico (maybe a Caribbean island or two) without a visa... that is the about all...

Maybe check whether your fiance can renew within America and then decide what's the best option.

Yes. However, if she should renew it before coming depends on when she is coming to the US. If she is coming this year, then just wait to renew it later on. Once you are married she should renew it anyhow with her name change and new address, etc. If she isn't coming until next year some time in 2009, I'd renew it before coming.

I have not renewed mine yet and I came in March of last year. I won't renew mine until I can actually leave the US on vacations once conditions are lifted next year. Mine is still valid anyhow. However, once your name changes you should change it all because it saves alot of problems when flying.

Yes, renew the passport if possible. It will be a lot easier to do in Vietnam than in the USA later. She'll need a Vietnam passport unless and until she becomes a US Citizen, so for several years.

Your wife, while now your wife, will still be a citizen of her home coutry (until, in the 3rd year of being married she applies for naturalisation). So if you were to travel together out of the coutry, she would be travelling on her coutrys passport you would be travlling on your US passport.

Gaining a visa for entry into different countries would be different for the both of you...your wife would enter under the laws stipulated between the coutry you are visiting and her home coutry, and for you, it would be the laws as stipulated between the visiting coutry and the USA.

Well, sort of. You're making important points but not quite accurately.

She'll be a citizen of her home country unless and until she becomes a US Citizen.

She can apply for Citizenship as soon as three years after being granted permanent residency. She can't apply for permanent residency until after the marriage, so it will be more than three years after the marriage.

Yes, if she travels internationally, she will use the passport of her then current citizenship and would be subject to the laws of countries she enters that apply to a Vietnam Citizen who is a US Legal Permanent Resident, not just based on her citizenship.

For example, there are many countries that give the same entry and stay privileges to US Permanent Residents as to US Citizens.

Yes I will confirm you now that until the foreign beneficiary gets the US passport after citizenship, they must use their passport of their country. I know this partially through practical life as well, as I was boarding British Airways to go see my husband, I noticed many people without US passports and some I knew had been here more than 3 years, and still they used their passport from India, for example, to travel after being here in the US for a few years. So yes, she should get the passport renewed because she will need it to travel until she can get the US passport after citizenship.

Well her passport is still gonna be valid for a while. Depends on when you are planning for her to come over. But if not necessary I wouldn´t renew her passport now since she will most likely change her last name after the wedding (I assume) so she will be changing her passport for a new one with her new name after anyway...
