Why is K1 faster? PLEASE ANSWER.

My question is simple and to the point:

Why does the K1 Fiance visa get processed faster than the CR-1 or the K-3?

I'm not hating on the fiance's, but it would seem that if your already married, that we would have more of a priority. A fiance visa is not a guarantee and the person could possibly decide not to marry the person anyway once they get here. With us married folk, we are stuck (not in a bad way hehehe) and would have to go through divorce, dividing property, etc...

I just don't get it.

I even heard one guy say that he was going to divorce his wife just to apply for the fiance visa and get her here faster. That is a crying SHAME to even have to go that far. Though I personally doubt that they'd get anywhere with that idea. But who am I.

Anyway, any comments?

:) im here but im not much help cuz im one of those k1 visa apps that didnt go fast lol ........but i understand what ur asking cuz for the most part k1 does go faster the only reason that i can come up with is that there are only a few things that we have to have proof of to get the noa2 were as when married there is a book of information and documents that u have to give and satisfy to what ever service center it went to

My thoughts exactly!I always wanted to ask that question but I was afraid that I would offend those seeking entry using K1.

I dont think anyone should take offense from a question like that ........sure k1 visa is for the most part easier to get a noa2 on but from what im reading it is a little more difficult to proof at interview time than a k3 but i could be wrong on that because we have no gotten that far lol.....

K1 is a non-immigrant visa with a path to immigration and the petition can be filed anytime after the couple has simply met in person. The intending immigrant must go through an additional adjustment of status before being granted permanent residence, so the "processing" is split into two or three phases. Filing to green card is not actually quicker going the K1 route but the separation time is.

CR1 and IR1 are immigrant visas granting permanent resident status to the visa holder in a one or two step process. Additionally, the couple must wait until they marry and have a marriage certificate to file the petition.

Historically, the K3 route from filing to visa, is within weeks of the same timeline as K1.

Why would being from serbia make anything take longer? There is DHL and FedEx in serbia. 2 day transit time. Should be like 100 bucks or something.

That dude is an idiot and going to get him self into a mess when he has to answer questions about previous marriages. He might as well kiss any hope of a visa goodbye. :bonk:

I actually posed this question to my senator's aide when I got him on the phone. My senator is on the senate sub-committee for immigration and has served on that committee for several years.

I posed the argument that it would faster for me to divorce my husband (it only takes ~90 days in AZ) and sponsor him as a fiance then it would for the comparable K-3 (divorce time included). He agreed and said he had heard that argument before and it was completely justified. He sated that the K-3 has not been processed or handled as Congress intended since he inception of the K-3 7 years ago. He said now, there have been several bills trying to reform immigration but they are all tabled and they kept getting bogged down with amendments to address the illegal immigration issues. Either way, I am an IR-1 filer and this doesn't help me at all. I filed in October and still am sitting on my thumbs waiting for a NOA-2, but it is a frustrating experience, to say the least.

I don't expect anything to change anytime soon as immigration is such a controversial topic right now. I did write a bit about it on my blog though and posed some ideas of my own on how to improve the system (link in my signature).

Think of all those guys who go for their 'mail order brides' (very big business) and just pick a snap shot off the internet site of 'Ladies looking for American Husbands' .... have a bit of email banter for a couple of weeks or so (while she's probably also emailing about 5 other sad old guys too, just in case .... but email contact is good proof for USCIS) .... send her a bit of money (financial commitment in the eyes of USCIS) ..... visit her for a couple of days in Timbuktu (you know the countries I'm really referring to ..... but this visit is enough to count as the one meeting required by USCIS) .... and think to themselves 'I'm really ugly and she's good looking .... having her around will not only make me look better .... but also make my mates jealous' ..... they apply for the K1 and low and behold after a couple of months, Little Miss Mail Order Bride is on her plane out of poverty ..... married within 90 days .... and living with some old man for a few years (pretending to be the cute little foreign wife) until she's been with him long enough to divorce his behind .... take his money .... and make a life of her own.

In the meantime, those who have actually spent time getting to know the person before they marry them .... have children .... are financing a home inside AND outside of the U.S. .... are stuck in a black hole of time where they have no idea as to when the next time they'll be able to see each other is.

So, really ..... looking at the processing facts ..... you want to know why a K1 is faster ?? ..... well, it's obvious .... being married makes us lesser human beings than someone who has only met their 'potential' spouse once (including mail order brides) .... regardless of the fact that the K1 and K3 are both non-immigrant visas and it's the same I-129F form to be filled out ..... it's so insane, it's laughable.

I do realize that it is unfair that the processing times are not the same, however, we all make the decision as to what visa we chose to apply for and take actions to follow through with that. It is no big secret that at this time, K-3's are taking longer. When people get married before applying, they are well aware of this and chose this path. The same for those who go the K-1 route.

I am also incredibly tired of being told that my relationship with my fiancee is not as worthy as those who are married. I am so offended by this comment and don't understand how people can say those things. No one can judge any other persons relationship, specially when they know nothing about it.

As for the "A fiance visa is not a guarantee and the person could possibly decide not to marry the person anyway once they get here. With us married folk, we are stuck " - are you unaware of the divorce rates or of how many posts are posted on this website alone a day with the heading "i'm getting a divorce, but I still want my greencard". Nothing is a guarantee these days.

My visa took 11 months from date of filing to having my visa in hand. I chose the K-1 route because i knew doing the K-3 would require me to be apart from my HUSBAND, not my fiancee. I didn't want to spend any time apart after marriage. I would in no way call tihs a 'quick' process.

We all have to wait, and we need to learn to do this patiently and not take it out on other visa types. Everyone agrees that this process sucks, but thats a decision we need to accept when we decide to marry someone in a different country.

That's exactly true. My post wasn't typed to be a personal attack on anyone.

I am simply trying to figure out something that makes absolutedly NO sense.

For example-

Here's a fake scenario

A unborn child is having complications and may die.

A newborn child is having complications and may die.

The doctor can only treat one at a time.

Guess what? The doctor WILL treat the child that is already here.

This is not an attack on anyone. It's just common sense.

Now, I know that we all chose our specific visa routes. What I was getting at is...Why does one process supercede the other. It should go in order of natural progression.

Again, this is not downing the K1 filers.

Think of it this way. What if the government decided to enact a law where those that are single with no wife/husband/kids,etc would get paid $100 more per pay period, and those that are married would get the same....just at the end of the year.

Would that make sense? You would think that the one's with dependants would need their $ now to take care of their dependants now instead of the end of the year.

Again, this is just a scenario.

May 7,2007-USCIS received I-129f
July 24,2007-NOA1 was received
April 21,2008-K-1 visa denied.
June 3,2008-waiver filed at US Consalate in Panama
The interview went well,they told him it will take another 6 months for them to adjudicate the waiver
March 3,2009-US Consulate claims they have no record of our December visit,nor Manuel's interview
March 27,2009-Manuel returned to the consulate for another interrogation(because they forgot about December's interview),and they were really rude !
April 3,2009-US Counsalate asks for more court documents that no longer exist !
June 1,2009-Manuel and I go back to the US consalate AGAIN to give them a letter from the court in Colon along with documents I already gave them last year.I was surprised to see they had two thick files for his case !


June 15,2010-They called Manuel in to take his fingerprints again,still no decision on his case!
June 22,2010-WAIVER APPROVED at 5:00pm
July 19,2010-VISA IN MANUELITO'S HAND at 3:15pm!
July 25,2010-Manuelito arrives at 9:35pm at Logan Intn'l Airport,Boston,MA
August 5,2010-FINALLY MARRIED!!!!!!!!!!!!
August 23,2010-Filed for AOS at the International Institute of RI $1400!
December 23,2010-Work authorization received.
January 12,2011-RFE
