This site is very helpful...Another question please.. I dont know what to put on my I-130 form for my wife's family name since we just got married for a few days.

Do I have to retain her original family name or use my family name instead? For example..Gandiola.(hers)and mine is Schiller. I will put Schiller on her info? When we applied for a marriage license . She took her family name since it is not allowed to use mine and I have no idea how it works when it comes to filing... We got married here in the US. She went back to the Phils. It's a long story why she went home..:)..

All replies are much appreciated. Thanks to all !!!

well the way i understand it her last name now becomes her middle name and her last name will be the same as yours if she wants to take your name but if you file in one name it is good to keep that name through the process so if you file with her maiden name then it is best to keep that name through the process. but it is best to have name change right from the start of the process

if she hasent legally changed her name, her name is what her name is.

If she kept hers family name she need to use that one. Me and my husband got married and I kept mine, and everything is ok. Nobody cares what name you are using if you have a proof for a relationship.

Getting married does not mean the names have to change. Whatever identification your wife is using when you complete the application is what needs to go on the form. It would be easier if you did not assume names will change and actually change the names and have identification to prove it. Also pay attention to the areas in some of these forms that specifically request for (maiden name). Regardless of how many times a woman changes her name when she gets married, her maiden name will always be needed because that never changes. In Puerto Rico (someone told me) women must use their maiden names all their lives (even after they marry). See if its the same in the Phils.
