HELP NEEDED!!!!!

Hello everyone,

I have a problem, on March 20, 2008, my fiance had his interview in Lagos, at which they told him his visa was approve. However, upon returning today he had to bring a copy of his son mother's death certificate and pictures of her funeral, which he did. Unfortunatelly wasn't issued his visa, but was given a letter stating.

"Dear Visa Applicant, We are returning your visa petition to the Department of Homeland Security office where it was approved with our recommendation that the petition be reviewed for possible revocation. Any futher inquires should be directed to that office. The reasons are as follows:

Evidence submitted indicated this is not a bonafide relationship and that the relationship is for immigration purpose only>'

When I call Homeland Security, this just tell me we need to wait 120 days. Has any one experience this, if so what did you have to do?

Oh yeah in 2006 we applied for a tourist visa, which was denied as well, would that have effected the K1?

One other thing the deceased child mother name is listed on the death certificate as same my fiance, however he claim they've never been married. The child mother has been deceased since 2001, but we did not list any information about her on the petition, as I saw no resaon since there's no marriage certificate in his home country.

Another thing, I only visit him once in 2006 in Lagos, because i wasn't able to fly back in 2007, due to accepting another job and relocating to a different state. May 2008 will be 3 years since we've know each other.

Any help is greatly appreicated.

This is something you are definitely going to want to keep on top of. Here is a link that I stumbled on earlier today. You will also want to take a look at some of the links posed on the Family Based Immigration Website, they have several very informative links about this very situation under their 221g section.

Start now gathering all evidence of a valid relationship that you can get your hands on: pictures, bank statements, proof of travel, phone records, statements from your families and friends stating that your marriage is valid, etc. ANYTHING you can get. This is serious, but can be overcome.

The denial of the tourist visa won't affect your situation unless any info on that application differs from the one on the forms submitted for the

K1. If it is evident that the k1 forms say you were engaged and the tourist application did not then that could present a problem, unless of course you truly were not engaged at the time of the tourist application.

We also tried for a Tourist visa ( B2 ) , many do and most get denied.

We have a similar situation with a late spouse.

She died in 1993. They were married only traditionally and no papers were ever signed or filed.

We chose to submit the death cert. and we entered her info in all the forms anyway.

We have been in AP for over a year and have the 2. interview in April.

I also have not been able to travel to see him since May 2006, I will be present at the interview for that reason.

Make sure that when you ask for congressional overturn of the recommendation for revocation that they know all these details and that no papers were filed for the previous marriage of his late wife.I responded in the sub-saharan thread also.
