Candid (love your photos btw), the point is not that there's anything wrong with filing the 129F, it is just that it classifies you as a K-3 filer, not a CR1 or IR1 filer. It is about keeping the data of CR1/IR1s separate from the K3s and nothing more. You could end up a CR1/IR1 anyway if USCIS processes you that way, but you filed as a K-3 by virtue of the paperwork you filed.

There is a K-3 spreadsheet that you should really be on.

Thanks MsZ. You are talking based on technicalities. I cannot see any reason why would I be in K3 spreadsheet if we would stick to CR1 in the end.

It appears that, in Vermont's case, the people who filed both forms get approved faster, so you would throw off the timeline on the spreadsheet for people who only filed the I-130. That is the point I think they're trying to make and the point they were kept off this spreadsheet in the first place.

Well if you guys think that I am not suppose to be in CR1 then remove me in the spreadsheet.. It wouldn't do anything in our visa process anyway.

The spreadsheet is just for record keeping and it would not do good nor harm our application. Feel free to do so. No harm done.

Yeah, that I-129F changes how Vermont would process you -- they see an I-129F and classify you as a K-3 and it is pretty clear that K-3s are given priority over IR1/CR1s. So, if you were to get approved it would make it look as though an IR1/CR1 was processed faster than normal because we're really only looking at I-130s and not I130s paired with I129Fs.

Gotta say, I keep holding off filing a I-129F because of no good reason... I don't know. I want a CR1 but if a 129F would help processing speed, I'd take a K-3. [insert gripe about the 2.5 months it took for them to give us a NOA1]

Well I finally broke down and done it. But, I have not gotten anything back yet still to early. I will have to change my status when I get it back. I should have done it several months ago when Vermont was doing nothing. I was trying to be patient and got the big for it. it was probaly a waste of time and effort now that Vermont is doing something.

Wow, alot happens by the time you close your eyes and wake up the next morning.

CaNdiD wiTcH - I didn't realise you'd also submitted the I-129f as I determine everything by people's timeline. I understand you may end up going the IR1/CR1 route instead of K3 in the long run but until then you are K3 Status. Yes, I agree it is a technicality but if for some reason your K3 process goes full speed ahead, it will provide those still making decisions on which Visa apply for, with some great stats. I will take you off the spreadsheet for now but as soon as you decide to go with the IR1/CR1, please let me know - and after all those stuff-ups and corrections I made to your name too!!! B)

Actually, I am really getting confused. As far as I know our lawyer also submitted I-129f together with I-130 but it seems that he didn't. I sent him an e-mail but I didn't receive any response yet. We receive just NOA1 for I-130 and that is a puzzle to me till now. Anyway, you could remove me and it is fine. I need to clarify few things with the lawyer first.

You also mailed I-129f right? The spreadsheet is exclusive for those who filed I-130 only.. :)

Technically we are considered as K3 because we filed I-129f..

What is it with lawyers? So often people have no idea what their lawyer is doing despite having talked to them about what it is they want.

There was a time when I felt that using a lawyer for something this important was a good idea. But that time has long since passed.
