When filling for a child under 18 years old do you also have to submit the I-129F or only the I-130

12/26/05 I go to Cuba

send I-130 Petition

03/02/06 recived NOA1

04/03/06 send I-129 visa

04/13/06 NOA 1 for I-129F in mail

06/07/06 I-130 Approved

07/05/06 Ref in mail (129F)

07/06/06 send back (129F)

07/07/06 rcvd I-864 Processing fee bill &DS-3032

07/09/06 faxed DS-3032 to al

07/10/06 send I-864 fee

07/11/06 send DS- 3032 (next day delivery)

08/02/06 send bill $380. recived 08/08/06

08/09/06 send affidavit of support recived 08/10/06

08/16/06 send DS 230- arrived at visa center on 08/17/06 at 8AM

08/16/06 I129 approved

10/26/06 1-130 completed at NVC

02/12/07 Visa was issued

When filling for a child under 18 years old do you also have to submit the I-129F or only the I-130

I recommend filing an I-130 for each intending immigrant because they will need one filed either now or with their adjustment of status. If you do not file I-130 for each now, there is no chance of an immigrant visa. You will be limited to K3/K4 and need to file the I-130s later anyway along with AOS.

If I were in your shoes today, I wouldn't file the I-129F at all. I'd go with the CR1/CR2 instead, but priorities do vary. You'll want to consider all this very carefully before acting.

You submit only one I-129F. It's for your spouse. Any children are listed on the I-129F. For a spouse, an I-129F is not filed alone. There must also be an I-130. Have you read the step by step guide for K3? No? Start there.

You family can come on immigrant visas or K3 non-immigrant visas. The K3 non-immigrant visa is for your spouse and the K4 is for a child or children. K3 and K3 require adjustment of status to permanent resident, after US entry. This is costly and time consuming. It also requires an I-130 be filed for each immigrant. You can file I-130s for children after K4 arrival but you must file an I-130 for the spouse as the first step in either the immigrant or non-immigrant process.
