I-94 number

Hello,

LOVE this site......I've learned so much about htis process and I am just about ready to submit our forms!!!

But...my fiance (love the way that sounds!) lives on his sailboat..and entered the US thru Lake Champlain in NY in the fall of 2006...he then sailed around the US and Caribbean with no problems. He visted family in Quebec in October and had no issues coming or going from New York....he was "red flagged" coming back into New York this month after a another recent visit to Canada to vist his sick mother...they pretty much advised him that he needs proof of job etc to come back to the US..

So..he is now working in Canada............and we are doing the visa process!

Question 12 on the I 129F petition asks for a I 94 number....we don't have such a number...should I leave it blank or do I need to explain the situation in seperate note along with the final paperwork...?

Hi, I just posted something about this that I went to Infopass for:

Ok so I had my Infopass today at the local Atlanta USCIS office and huge suprise I was helped in 20 minutes.

Anyway while I was waiting I was chatting with the Officer that is in the Customer Service area. I casually asked her about coming in as a Canadian Citizen and not receiving an I-94 or stamp of entry. (This is as a visitor)

She shrugged and said it happens ALL the time, it is kinda overlooked as far as USCIS is concerned. (I buttered her up after a difficult client and she spilled). She did mention however that some have gone to the Duty officer at their local airport and just asked for one.

Then when I spoke with the Immigration Officer at the window she verified that I-94 is kinda overlooked as far as Canadian's go. She said to just put a letter and let them know the date and POE you came in and they didnt stamp you.

So, there is my experience and maybe it helps

You say that your fiance is in Canada and working? Then you don't put anything in that part of question 12. Well, put N/A perhaps. That question is if he's currently in the US.

You say that your fiance is in Canada and working? Then you don't put anything in that part of question 12. Well, put N/A perhaps. That question is if he's currently in the US.
