I-134 & I-864

What's the difference between I-134 and I-864...Were just a bit confused..my husband sent me the I-134..then the lawyer told him that he received the I-864...what ive known that is when i get there for my AOS...please need some clarification about this.God bless!!!

K-3 Visa

Marriage : 2007-02-26

I-130 Sent : 2007-07-05

I-130 NOA1 : 2007-07-13

I-134 is for NON-Immigrant visas. K-Visas are NON-Immigrant, so the consulate uses I-134 for them.

I-864 is for GREEN-CARDS, this is used by the consulate only for IMMIGRANT visas like CR-1 and IR-1 spousal visas. I-864 is later used by K-Visa holders in the USA when they file I-485 to adjust status and apply for a GREEN-CARD.

Other Immigrant Categories - When an I-134 May be Needed

Do applicants who are applying for an immigrant visa in a visa category that does not require the I-864 Affidavit of Support, such as the diversity immigrant visa, need to meet the public charge provisions of Section 213A of the INA?

Consular officers will review immigrant visa applicants whose visa categories do not require the I-864 under the public charge guidelines in Section 212(a)(4) of the Immigration and Nationality Act. The applicants must show that they will not become a public charge. A consular officer may ask for an Affidavit of Support, Form I-134 and supporting documents. The sponsor will need to show income at 100 percent of the federal poverty guidelines for household size, not the 125 percent required under Section 213A of the INA.

Should K-1 fiancé(e) visa applicants use the I-864 or the I-134? (K-3 comes under this too)

Since fiancé(e)s are nonimmigrant visa applicants, they should use the I-134. They will need to submit an I-864 to U.S. Citizenship and Immigration Services (USCIS) when they adjust status to conditional immigrant in the United States after they are married.

Yes, most likely, you need to take I-134 with you for your interview. But check with the Embassy website to be sure or email them. I heard from someone that in rare cases, few Embassies/Consulates want I-864 for nonimmigrant K-3 visa. Your lawyer may have received I-864 for cr-1 process, because you are pursuing both cr-1 and k-3 at the same time?

I-130 Timeline with USCIS:

It took 92 days for I-130 to get approved from the filing date

NVC Process of I-130:

It took 78 days to complete the NVC process

Interview Process at The U.S. Embassy

Interview took 223 days from the I-130 filing date. Immigrant Visa was issued right after the interview

IF it is a K-3 visa interview it will need I-134, if for some reason the CR-1 gets to the embassy, and you are interviewing for CR-1 visa then the support form needs to be I-864 because CR-1 is a GREEN-CARD visa.

j. EVIDENCE OF SUPPORT. You should be able to demonstrate that you will not become a public charge or be a burden on the U.S. taxpayers for financial support. A completed I-134 Affidavit of Support Form will be useful to the consular officer to evaluate your petitioner’s ability to be financially responsible for you. You should also submit your petitioner’s most recent U.S. Federal income tax return (Form 1040) and wage statements (Form W-2). Employment letters stating salaries and bank statements may be included to substantiate the I-134. Download Form I-134 at http://www.uscis.gov/portal/site/uscis.
