Do you require a marriage license to show at the embassy

Hi Everyone,

I was just wondering if a marriage license is needed as part of the required documents at the K-1 Visa interview, do i need to get my wife to obtain one along side the affidavit of support? am still awaiting the interview date thou, as i was told could take up to 6-8weeks, please advice!

No you don't need a marriage license for the interview. Depending on the state you plan on marrying in, both of you may need to be present to obtain one and they are not good indefinately. Here in North Carolina a marriage license is only good for 60 days from the date it's issued and we both need to be there to get it.

If you are not yet married how can she be your wife????

To refer to her as your wife is a big mistake.... if she were to refer to you as her husband at her interview she may well be asked for evidence that you are not already married.... or if she were to refer to you as her husband when at POE they could deny her entry on her K1 because you must be unmarried to enter on a K1....

The onus would be on her or you to prove that you are not married....not on USCIS to prove you are.... that is not an easy thing to do....

If she is your wife you should not be applying for a K1 visa.

The marriage license is the pre-cursor to a wedding ceremony and the ultimate marraige which results in a marriage CERTIFICATE. The OP simply asked if the license was needed...
