OK I don't know which Forum this would belong to so I put it here.......I just found out that my SO recently found out that he MIGHT have a daughter.I don't have a clue how old the kid is or anything else.Like I said he himself apparently just found out.

I found out by accident,not from him.(He's obviously scared of my reaction and rather stresses out about it then telling me which is currently causing big problems).

My question now is,IF that child is his and he had no clue about that child being there when we did the papers can we still get in trouble with the USCIS for not stating the child?

Probably a stupid question since you cant list something you don't know about but still,just want to be sure .

Thanks for advice,PLEASE no rude or so called funny comments.This is bringing on a lot of stress as it is.

Oh wow, I'm sure this has been a very stressful time for you, and one of shock. You mentioned that your fiance didn't tell you, so is this something you've at least talked about yet or are you pretending you don't know anything yet? My word...the energy this will take to keep secret will be very stressful. Please talk about this to him.

Is your fiance the US Citizen? I thought I remembered other postings indicating he was. If so, I don't know how this could impact on your visa journey insofar as USCIS is concerned.

Even if your SO is the beneficiary, I doubt very much he would be bringing this child to the US with him, so again, there is nothing that USCIS needs to know.

I'm sorry you're going through this right now. Please let us know how this evolve.

I suppose USCIS wouldn't cause any problems if it would be indeed determined that the child is his, as you said he didn't find out until now so he couldn't list something he thought didn't exist. If and when it happens I'd make an InfoPass appointment bringing all the pertaining papers and see what the IO suggests as to how to go about this to "fix" the situation with them.

ETA: I just saw you guys are still waiting for your K1, correct? Then maybe, he could talk to someone at the consulate to find out what to do about this.

(exactly on the 90th day mark...applications NOT returned although some scared me into thinking they could have!)

30th july 2007 - N-400 delivered to VSC

11th august 2007 - Delivery Confirmation receipt received

17th september 2007 - Money Order (FINALLY!) cashed

9th november 2007 - NOA! (notification period given 180 days)

21th november 2007 - Biometrics appointment letter

18th december 2007 - Biometrics appointment in Baltimore, MD completed

29th march 2008 - FINALLY received letter with interview date!

8th may 2008 H 8:40 AM - Interview in Baltimore-APPROVED!

8th may 2008 H 3:00 pm (yes same day, crazy!) Oath Ceremony in Baltimore

24th may 2008 - US Passport application mailed off

6th june 2008 - US Passport received in the mail!!!

Nat,

I can't imagine this 'news' would cause any immediate problems in your petition for two main reasons:

1) He (you) didn't know.

2) He is not supporting the child financially.

As a side note - a third reason might be that this 'news' is yet unconfirmed.

Does he actually have to put the child on the papers if the child is not immigrating with him? I really don't know cause we did not have to do that and I forget what the papers say now.

I agree with find out if it is his before making any other decisions. And, then, just deal with it. There is really no way to go back and change things. I wish you the best in whatever your future brings you.

The husband is the USC, and for the purposes of the immigration of the foreign beneficiary, this would only matter(if at all) at the Affidat of Support, should the USC choose to support the child. Otherwise it does not matter in the immigration scheme of things....any other aspects of this scenario are personal and should be dealt with 'en familie'.

If the child IS his there should be no "should he decide to support the child" about it. He SHOULD support the child.

But, cross this bridge when you come to it. Get the paternity test done first and take it from there.

When you filed the petition your USC SO submitted them with accurate information that was known at the time of filing. There can be no consequence for something that was not known. This would be no different if one of the was pregnant at the time of filing and subsequently gave birth during the process....
