My wife and I went through the K-1 visa process and mailed our completed (AOS) packet to the USCIS office last week. Today we attempted to sign her up to take a drivers permit test but an employee at the drivers license office rejected our application after he looked through my wife's passport. He said we needed a resident card or a different visa in order to apply or something like that.....

We REALLY don't want to wait for the (AOS) to be completed before applying for a drivers permit. Is there something we can do right now in order for her to be eligible?

did you check your local DMV website for the requirements? because i applied for my driver's permit before i got EAD or AOS. i just had to provide my SSN and passport.

also....why not try going to another DMV site? when i applied for my SSN for the first time, the clerk was very rude to me and was sure i couldn't get an SSN without AOS. i left that office and went to another SS office, where i got my SSN with no problems.

In california you need EAD to get the license. I tried with my I94 but they said that it has to prove I can be legally in the country for over 6 months.

but they said I can drive as a tourist on my home license, as long as its valid. Its only when I become a "california resident" that I need to have a california license. A california resident apparently is not the same as a US resident... typically over-complicated government un-joined-up-thinking

I got mine as soon as I arrived here in Florida.. I showed my passport and I-94 and nothing else... they didn't even ask my SSN... now I have another issue.. may be somebody knows??? When I got my US Driving license (after marriage) lady in DMV here in Florida told us that I can't change my last name in driving license till I receive any papers from USCIS saying that that started my AOS process.... but when we went there agin after we receive NOA they sent us back saying that I need to bring GC... so does anyone know what should we do... or may be somebody knows DMV rules saying that they can change my last name without GC... Thank you guys

The foreign country DL should work on a limited timie on most states. If it's expired or if it's not honored, and you already have received your NOA for your AOS/EAD, present that with the Marriage Certificate, and it should be accepted. When I came here October, I was able to get a DL based on my I-94. When my I-94 expired, I cannot renew it for a week until I got my AOS/EAD NOA receipt. When I went back to DMV to show them my NOA they just needed to see the Marriage Certificate. They renewed my DL for another year.

I got my drivers license in South carolina..I had to wait for the NOA for I-485(to prove I was adjusting)..that and my passport..I was good to go! In SC there is only 1 DMV that can do international customers..and not all DMVs here knew that,,,the first one I went to told me I would need my gc..

If I were you I would call your state DMV and ask them if there is a special office that handles people immigrating..Good luck!

The foreign country DL should work on a limited timie on most states. If it's expired or if it's not honored, and you already have received your NOA for your AOS/EAD, present that with the Marriage Certificate, and it should be accepted. When I came here October, I was able to get a DL based on my I-94. When my I-94 expired, I cannot renew it for a week until I got my AOS/EAD NOA receipt. When I went back to DMV to show them my NOA they just needed to see the Marriage Certificate. They renewed my DL for another year.

Please specify which state you did this in? Arizona? Every state is different...

As TomG wrote: in California, we cannot get a DL valid for longer than our K1 I-94 UNLESS we show an EAD or GC. My understanding is that a NOA for AOS or EAD is NOT enough here.

My case: I got a temp license based on my (expired!) foreign license. Now that temp license has expired and there is nothing much I can do until I get the cards (or maybe the approval notices suffice). Perhaps I can take the practical driving test. Strangely enough, I got the temp license WITHOUT the practical test, just had to pass the theory.

South Carolina seems a lot more advanced than ol' Cali. There is even a reference to K1s on the SC DMV site!

Applicants with a K-1 Fiancé(e) status

• Marriage License

• I-94

• Notice of Action Form I-797 showing applicant has applied for permanent residency status.

Not too shabby...here that wouldn't be enough...I think. Anyone had a different experience?

BTW, SC has 16 offices that deal with international customers not just one. Just so ya know...also, if you have a license from France, Canada or Germany, some kind of reciprocity kicks in, making the procedure slightly smoother I imagine...

Oops..lol..I should have been more specific..Charleston only has 1 office..but you're right..they appear to be ahead of the game..my daughter received her learners permit b4 I could get my DL!(all she needed was her passport and school i.d(to prove she's a resident!)

They need proof of legal presence... If you cannot provide this proof then there is nothing they can do.

Maryland was a straight trade..

then i moved to texas.. thankfully i had the MD license they just traded it straight over with out the EAD...
