Hi,

I'm currently under OPT (exp May 08). My fiancee and I are gonna get married in April 08 and I'm gonna apply for AOS and EAD afterwards. I was wondering is it legal to volunteer working without getting paid (on the same workplace I work now) before EAD is granted?

As far as I know working is working and volunteering is volunteering... As long as it is a "true" volunteer position that somehow does not magically translate into a "paid" position after you receive EAD you have no worrries.

A company cannot utilize volunteers unless it is non-profit. Then even if it is non-profit there are guidelines. Believe it or not! I have worked for a nonprofit that did not follow the guidelines, but who is going to penalize a nonprofit.

I now work for a non profit that was asking me to allow a temp to upload documents into a new software we are utilizing. I said no, but I have plenty of filing.

We can only use temps if it is for a 1 time or on occasion task that would not take a job from someone. Now I am not sure if this is a Maine thing or a Federal.

You've been working for this company and now you're not, but you want to volunteer there until you get your EAD, then perhaps go back to working with them again? The answer would be NO.

If you want to do volunteer work, go to someplace that is looking for volunteers, and there is no promise of employ.
