Hi guys!

So I'm reading that my US finace needs to be 125% above the poverty line (in terms of income when submitting the 1-134 Affidavit of Support).

I have browed around online by I am failing to find any recent information that I can understand.

Roughly, how much does my US finace need to be clearing in his paychecks to be above the 125% poverty line?

Further my fiance and I have just started new jobs as we were both living abroad. We are about to submit our 1-129F, should we be concerned that our recent income will be minimal?

Should we include bank statements from foregin bank accounts that we had whist working abroad?

The line is Gross income so it is income BEFORE tax, and deductions. This is NOT take home pay.

You count sponsor, any dependents of the sponsor, the prospective immigrant and any children coming to the USA with the prospective immigrant.

Guideline: http://www.uscis.gov/files/form/I-864P.pdf

Bank statements ate not needed if income is above 125% line.

One thing about I-134, the directions included with I-134 are very old, USCIS has no reason to update them since USCIS has no application for that form.

The consulates tend to treat the I-134 like a mini-I-864 as so prefer the same financial evidence as the I-864.

In our case this what the I-134 included.

  • I-134 signed and notarized.

  • SIMPLE Tax transcripts from the IRS for past 3 years, (Redundant for the (1040,W2,1099) but are free from the IRS http://www.irs.gov/faqs/faq1-6.html

  • Photo copy of IRS form 1040, and W2s for past 3 years (Not necessary if you provide the transcripts)

  • Letter from my employer stating annual salary, job responsibility, and that is full time, on company letterhead.

  • Photo copies of past month or so of pay stubs up to a few weeks before the interview.
My income was well above the povertyline so I did not include any asset data (LIKE BANK STATEMENTS or property values).

If your income exceeds 125% or (100% for military) of the povertyline when counting yourself, prospective immigrant and any dependents, then don't bother with assets (401K, Bank balance, Stocks etc..), it is just extra un-needed data to provide, the consular officer is most concerned with INCOME.

Bank accounts MUST be in the USA in order to be counted.

NOTE: Assets are only worth 1/3 income, so if income is below the line by 1000 then 3000 in assets are needed.

You may want to Consider a co-sponsor.

My partner is in Ohio and they have a somewhat criminal minumum wage for servers (as servers get tips from patrons). I am concerned with my partners GROSS wage as it does not take into account his tips that he clears daily (which are quite high!).

How do we go about geting a co-sponsor and where can I find some additional information about this?

Should we get a letter from the place where he is doing his internship, confirming he is 'studying'.

Co sponsor tends to be a relative willing to provide an I-134 and financila evidence. The co sponsor is only responsible for the time that the prospective immigrant is NON-Immigrant, that is until they get green-card.

The co sponsor does not need to also be joint-sponsor for the green-card, your fiancee the petitioner can solo sponsor for the green-card if income situation is better by that time.

Did he file his 2007 taxes (due on April 15, 2008)? If yes it should work, because he needs to declare his tips as income - if he chooses not to declare that as income - that's another matter and then you should look for a co-sponsor. By the way its legal and quite common to pay below minimum wages in the Restaurant/Bar industry as they know that tips make up a lot more than enough. Some places e.g. in Vegas they even have the waitresses pay the casinos! Good Luck

Hi guys!

Here's the formula: (income + assets/5) >= (2008 federal poverty guidelines x 1.25)
