I'm a student on an F-1 visa, is the F-1 visa eligible to Adjust status to that of a permanent resident? I have read the guide about marrying when already in the US. My boyfriend and I have dated for 3 years, we want to know if it would be easier(less expensive) to marry now or have me go back to Canada and then apply for K-1 fiance.

Heres the question, do I file ALL the forms listed TOGETHER and mail it to the Chicago lockbox? I would want to apply for EAD and looking at statisitcs everybody else's timelines its within the 30 to 90 days.

I already have a SSN because under the F-1 visa I worked on campus and off campus during this past year because of Optional Practical Training, which means I already have had an EAD, but it expires in two months along with my F-1 visa. What does SSA need to know regarding AOS?

Going back to my F-1 visa and EAD expiring @ the end of May, when would I have to apply for AOS? before end, after end of May? I do not want to fall out of status and become deportable. I am assuming that i would not be able to travel back to my home country while my application is in processing unless I have AP, which also takes about 3 months or so looking at the statistics.

My state drivers licence expires as well at the end of May because it was temporary reflecting the date on my I-20, when could I renew it, do I have to wait until the I-485 is complete and I am interviewed?

Adjustment of status based on marriage to a US Citizen is the easier way to go. You did not enter the USA with intent to immigrate so this is not a problem.

F-1 does not allow direct adjustment of status to LPR. In order to remain you must marry and then file the I-130, I-485 and I-765 all at the same time.

SSA really needs to know nothing until you have your status adjustment is completed

I would apply for AOS as soon as practicable after marriage...

State licensing laws differ but most wil require evidence of lawful presence in order to renew a license. For example, if your EAD document is approved before your greencard, many will accept that as evidence of lawful presence

Everything you mention on your post is correct. It is better to adjust status here than going back to Canada and apply for the fiance's visa. Since you didn't come w/the intention to get married, you'll be fine. All the answers of the prior members are correct as well. I would get married and file for Adjustment of Status before your OPT ends just to avoid falling out-of-status. Since your OPT expires on May, you will not be able to work legally until you receive your new EAD but at least you will be pending and legally residing in the US. Just get married and file on March and you will have to take just a month of vacation until you receive your work permit on 90 days hehe. U can even talk to your current employer, explain your situation and work as a volunteer during that month and go back to work legally as soon as you receive your new EAD.

As you mentioned above, you are not going to be able to return to Canada until you receive your new AP. About your drivers license, well here in Texas I guess is different because they issued me a 7 yr license, got it on 2005 and expires until 2011, even though my F-1 expired on 2008. I guess you can apply as soon as you receive your new EAD but I'm not sure.

Thank you everyone for your replies! Found out by looking at the state drivers licensing page that they will accept EAD as proof of legal residency, but it is still going to suck not being able to drive after the end of May and until my EAD arrives! My employer may have a hard time trying to find someone to fill my position so maybe by the time my EAD arrives it would still be open! Hopefully! My current supervisor is retiring, may make a difference, I don't know.

One more question, I bought my car in Canada and temporarily imported it to the US in October 07, is there a way to permanently import my car? I thought I read somewhere that there are no extensions on the temporary import, but maybe that meant it cannot be temporarily imported again, but could be permanently imported. If anyone could help me on this that would be great!

It primarily will be a state thing, I would think... check with the department of motor vehicle in your state

It is not a state thing, I had to go to a POE to get it inspected and get a import doc to take to the state DMV. Maybe I will call the border

It is not a state thing but yet you had to get a document to take to the state.... I would still think the state DMV would be a source of procedural information and required documents if any you must have from the border.

It depends on what state you live in but some only require that you have a SSN, an old ID (like your DL that you have right now), and a piece of mail, like a bill or a bank statement sent to your address in the US. Other states are more picky about it. Maybe you could go in and try and get a new license without saying anything about immigration status.
