new affidavit for the interview

Timeline

We had a sponsor because my husband was a student and didn't make enough in 2002, 2003 or 2004.

In 2005 he was employed and made enough.

For our interview, do we need an updated affidavit? The receipt of our filing was Jan 4, 2006

And if so, who has to do the new affidavit?

My husband?

Our sponsor?

October 30, 2005 - Married in Vegas

December 27, 2005 - EAD, AP, AOS mailed

January 4, 2006 - received in Chicago

January 27, 2006 - RFE for medical received

February 13, 2006 - Medical received

February 15, 2006 - Biometrics appointment at 10 am

March 1, 2006 - AP touched

March 4, 2006 - AP received

March 8, 2006 - EAD received

March 29, 2006 - interview notice received - May 31, 2006

May 31, 2006 - Successful interview!!! Approved

June 12, 2006 - Green card received

Feb 28, 2008 - will be sending removal of conditions docs.

I would do both.... you may find that if your husbands income is enough for 2005 you no longer need a co-sponsor.... that is what happened to us at our interview.... the officer said we did not need a co-sponsor and gave us back all the paperwork from our co-sponsorand just kept the new paperwork.....

Agree with Kezzie.. Do the paperwork with the 2005 tax return (only the last filed tax return is now required by USCIS) and list the 2005 income. However, have a co-sponsor in your back pocket.

At the interview, only present your spouses I-864 and try to get approved on that. If they hesistate and ask for a co-sponsor, you'll have the paperwork available. If they don't ask for it, you can shred it or give the I-864 back to the prospective co-sponsor for them to shred it.

The situation at our sponsor's hasn't changed, still the same job.

Does he need to give new pay stubs or just the tax return?
