After entering the US with a CR-1 visa and leaving the US without the green card in hand, is it possible to enter the US again without significant red tape? Does the situation change even with a green card in hand? we both found good jobs in Turkey and might want to keep them....

I've heard horror stories of people who had to start the process all over again. Anybody have any experience with this?

06/11/07 - I-130 received by USCIS

03/14/08 - NOA2 for I130 and I129 approval notification by email.

Not a problem, the officer at the POE will stamp your pasport with I-551 stamp, when you enter on the CR-1 visa, this makes your passport into a temp Green-Card. The I-551 stamp will allow re-entry until you have actual green-card in hand.

Your signature shows I-129F approval too, so you may be getting K-3. K-3 is multi entry so it too allows re-entry from trips abroad.

Trips abroad more than 6 months long can be considered as abandoning LPR status, Trips linger than 1 year require a re-entry permit (I-131) trips longer than 2 years will need a returning resident visa.

Be Careful! Extended trips outside the US during your CONDITIONAL RESIDENCY (CR) 1 visa can jeopardize your visa and you could lose it. This is what an immigration lawyer mentioned when I said my husband was thinking of taking a job in UAE after getting his CR1 visa. During the first two years you are required to stay inside the US for a specific amount of time.

Make an infopass appointment to speak with a local USCIS representative to find out what the time restrictions are for travel outside the USA during your CONDITIONAL RESIDENCY.
