Hello,

I've just received my pack 3 and im trying to gather the correct information for application. My fiance has filled out his application of I-134 affidavit of support and sent me his supporting documents. However it states that you need a statement from an officer of the bank to give details of date account opened, total amount deposits for the year and present balance. My fiance has received this statement except it does not include his deposits in his account for the past year. The bank officer said it was going to be a problem as they didn't have the technology to automatically check deposits asap. He said he would have to manually check the deposits and then add up the total. Will this be a problem? Should I make my fiance go back to the bank and request for his deposit details? Or should I just send through what I have? Thanks for your help in advance.

I am not an expert by far on this point but I'm at this portion of our process and I've not included that since my income is above the 125% poverty level. Is your fiance's above or below and that is why you are including the bank statements? I do know some banks depending how big they are do not have a way to do this. It's a pain but true.

Letter from bank is only needed if your sponsor is relying on using the bank account as an asset to make up for a shortfall in income. If income exceeds 125% poverty line then bank statements are NOT required.

One thing about I-134, the directions included with I-134 are very old, USCIS has no reason to update them since USCIS has no application for that form.

The consulates tend to treat the I-134 like a mini-I-864 as so prefer the same financial evidence as the I-864.

In our case this what the I-134 included.

  • I-134 signed and notarized.

  • SIMPLE Tax transcripts from the IRS for past 3 years, (Redundant for the (1040,W2,1099) but are free from the IRS http://www.irs.gov/faqs/faq1-6.html

  • Photo copy of IRS form 1040, and W2s for past 3 years (Not necessary if you provide the transcripts)

  • Letter from my employer stating annual salary, job responsibility, and that is full time, on company letterhead.

  • Photo copies of past month or so of pay stubs up to a few weeks before the interview.
My income was well above the povertyline so I did not include any asset data (LIKE BANK STATEMENTS or property values).

If your income exceeds 125% or (100% for military) of the povertyline when counting yourself, prospective immigrant and any dependents, then don't bother with assets (401K, Bank balance, Stocks etc..), it is just extra un-needed data to provide, the consular officer is most concerned with INCOME.

Is now a US Citizen immigration completed Jan 12, 2012.

My fiance's income is above the 125% poverty line. I also have on hand his last tax return.

IF it is above the level required (and as mentioned by the above) you only need a letter from the employer and generally last years income tax documents. I sent my fiance 2005,2006 and 2007 just because I had them. Past that you don't need to send a letter from the bank or any information on assets. Hope this helps.

all erin sent me was a statement from the bank saying when the account was opened and the current balance, it was notorised at the bank that day and this was sufficient
