Timeline

I've never read about one person who had the ban waived at the manila embassy for admitting to using drugs. I listened to a man plead with the CO at the embassy with three little children begging them to give his wife the visa but she didn't get it. For 5 years the man tried everything to no avail. If anyone knows of an instance where a waiver was approved for drug use at the manila embassy I would appreciate them posting it for my own and others curiosity. Thank you

I have to wonder, what is more important for some people, their drugs or their family/fiancee? I've never used drugs so it's not even a decision I will ever contemplate. Riza is more important to me.

I have to wonder, what is more important for some people, their drugs or their family/fiancee? I've never used drugs so it's not even a decision I will ever contemplate. Riza is more important to me.

its not really about a choice of drugs or family... somehow people use drugs for some reasons they can only answer. i dont use prohibited drugs and im not perfect either... ive got issues myself... lol... and i dont think when they're taking drugs, meaning they already choose it over their family etc... although when it comes to visa process, its either admitting using drugs and be banned or being with their family/loveones... of course i bet by all means they would love to choose their family if they can help it (creating a lil lie)... and i respect that decision with a smile :) lol

to edit: what i mean was using prohibited drugs before and already clean/ regretting the past and changed for the better

Just so we're clear on my post, I dont use drugs, and I dont advocate drugs. Heck, I dont even smoke. I was merely answering the OP's direct question directly.

I also responded to Jomo because he thought the ban was 10 years for Philippine based applicants based on a previous posters replies (The Citizen Pinoy one) and I just had to correct that and say that it is indeed three like he originally thought. I also said that one can apply for a waiver and IF approved, the ban would be lifted.

That's all. Ive posted no opinion on the matter.

If I will be on the OP's situation and used drugs in the past, I'd think about the hardship that my fiance and I had to go through to make it this far. This journey is not only expensive but also long, tedious and emotional restraint. I'd think about the heartaches that we had to go through from being so far from each other. And also, the future waiting for us together... Having said that, I'd take the chance and lie about it. Like I said, a little white lie is not gonna hurt. If you will feel guilty about lying, just consider revising the question "Have you used any prohibited drugs?" in your mind into "Have you used any prohibited drugs last year?" :whistle: Say NO and it's true... you didn't use drugs last year, 'aight?

If I remember from my trips to PI correctly, isn't the sentence for drugs life?

The son of the mayor of Manila is facing a life sentence for possession and sales of shabu right now.

It's the severity of the offense in the Philippines, even admitting to it, that causes what may seem to be harsh consequences.

A) Conviction of certain crimes.-

(i) In general.-Except as provided in clause (ii), any alien convicted of, or who admits having committed, or who admits committing acts which constitute the essential elements of-

(I) a crime involving moral turpitude (other than a purely political offense or an attempt or conspiracy to commit such a crime), or

(II) a violation of (or a conspiracy or attempt to violate) any law or regulation of a State, the United States, or a foreign country relating to a controlled substance (as defined in section 102 of the Controlled Substances Act (21 U.S.C. 802)), is inadmissible.

(ii) Exception.-Clause (i)(I) shall not apply to an alien who committed only one crime if-

(I) the crime was committed when the alien was under 18 years of age, and the crime was committed (and the alien released from any confinement to a prison or correctional institution imposed for the crime) more than 5 years before the date of application for a visa or other documentation and the date of application for admission to the United States, or

(II) the maximum penalty possible for the crime of which the alien was convicted (or which the alien admits having committed or of which the acts that the alien admits having committed constituted the essential elements) did not exceed imprisonment for one year and, if the alien was convicted of such crime, the alien was not sentenced to a term of imprisonment in excess of 6 months (regardless of the extent to which the sentence was ultimately executed).
