My husband and I have sent an application of I-130 in last December. Since we didn't see any instruction saying that we should/could file I-485 along with I-130, so we didn't. I-130 was received at Chicago and it's been pending at California Service center (?) according to the online status.

We realized that we will have to file I-485 to adjust the status, but could we have sent it together with I-130? The instruction said that we needed to write visa number on the form. Can we send the form of I-485 seperately to Chicago office now? Or we should wait until we hear from the office?

Also, I hold E-1 visa and have lived in the U.S for 15years. We married on last September. Until we file and I am approved for I-485, my status of E-1 will remain the same?

Please advise! Thank you.

You should have mailed the I-485 and the I-130 together to the Chicago lockbox.....

What you will need to do now is file the I-485 and EAD and AP along with a copy of the reciept you have for the I-130.... this has to go to the Chicago lockbox....

Sadly you could have had youre greencard by now if you had filled it all together.... but you should not have any further issues once you file for the AOS....

but dont panic, I asked the same question on this board before and some told me that it was a majour mistake, I panic'd and cried. but it is realy no problem, just do what Kezzie said and attach the receipt of the I-130.

03/26/2008 RFE for I-130, sent to LA Through USPS Certified mail

03/31/2008 I-130 RFE response letter is received

04/09/2008 I-130 case processing has resumed

04/17/2008 I-130 APPROVED!!!! DATED 04/14/08 YAY!! 7 monthes to approve.

03/13/2008 Sent I-485 & EAD to Chicago Lockbox through USPS Priority Mail

03/16/2008 I-485 & EAD Received by R. MERCEDO USCIS Chicago IL

03/25/2008 Received NOAs for I-485, I-765

03/28/2008 Received Biometrics Appointment Notice

03/29/2008 Biometrics done-Appointment Scheduled 4/05, but I went early.

03/31/2008 Case Status shows up Online

04/03/2008 EAD touched

04/10/2008 RFE for I-485 received today, dated 4/04/08

04/11/2008 Sent RFE to Lee's Summit, MO / USPS priority mail

04/14/2008 USCIS received RFE response; signed by C BORDERS.

04/17/2008 Case processing resumed

04/22/2008 Touched

05/09/2008 Received EAD Approval Notice from CRIS "Card production odered"

05/14/2008 EAD card production ordered, 2nd notice

05/16/2008 EAD Approved & Sent!! (61 days)

05/19/2008 EAD in hand!!!!!

but dont panic, I asked the same question on this board before and some told me that it was a majour mistake, I panic'd and cried. but it is realy no problem, just do what Kezzie said and attach the receipt of the I-130.

Don't worry too much about this. I did the exact same thing as you. My I-130 was sent in Sept 2007 but I only sent in my 1-485 at the end of Dec 2007 because of financial issues. It extended the processing time but so far I have had no problems and have just received my EAD and AP approval notices in the mail. The i-130 and 1-485 don't HAVE to be sent in together but it makes the process quicker for you. My I-130 was in California and after I sent in my I-485 application, the I-130 was sent from the California Service Center to the Missouri Service Center to join my I-485 application.

Trust me, this is nothing to worry about. You are one of many people that have sent in these applications separately.

Thank you for the information. I didn't know what the I-485 was when I was filing I-130. The instruction for I-130 and any other visa information site or booklet doesn't even mention about I-485. When I heard that someone mentioned about I-485, I researched on USCIS, and here it is!

I will research about EAD and AP (I don't know what those are, too.) tonight at home.

As you had financial difficulty, we wouldn't be able to pay for the I-485 filing fee at the time of filing I-130, either.

Now, we can probably file for I-485. I try to think I came out the way it should be.....
