Hi Everyone,

I'm confused when trying to list category type for my wife who came to the US on K-3 and I'm US citizen. I'm preparing docs to file for her AOS but not sure which category to list in i-765 (a)(9) or C 9??? Please explain.

Q2: Can I fill i-765 electronically and still not pay the fee (I think if you file it with i-485 and pay $1010, i-765 gets covered so does the i-131. please correct me if I'm wrong)? I like to do it electronically to save time in processing.

If filing for EAD with or after filing AOS (I-485) it will be C 9 based on PENDING I-485. The Fee will be part of the $1010 paid for the I-485.

If filing for EAD before AOS then it is A 9 Based on Life act K-3. FEE is $340.

Many K-3 will file EAD before AOS and pay the fee so that they can work and get SSN before filing the AOS, the reason is to file AOS just before or just after 2nd wedding anniversary, this avoids the CR-Green-Card and the higher fee needed to remove conditions on the CR-Green-card 2 years later.

Filling for EAD by e-file will not save you any time other than time spent in the mail.... if you want to e-file for the EAD you will need to wait until you have recieved a NOA1 for the AOS so that you can include the receipt number on your e-filed EAD or you will have to pay the fee and USCIS do not refund fees....

Thanks YuAndDan, So if i'm filing I-485, can I file i-765 electronically? or do I have to have recipt number for i-485 before I can file online? The reason I would like to do EAD part online is that it will take less time and while AoS is pending EAD can be processed and SS# can obtained.

Another question regarding A#: On the approval of i-129f the number is A# 012345678 but on i-94 officer wrote A# 12345678 so in AOS docs which one should I use?

A# is a 9 digit number so add the leading 0
