Already Have Social Security Number

Hi,

I'm sure this has been asked but I did a search and can't find the answer.

I already have a work authorised Social Security Number from a previous US Visa. It's obviously still valid and will be in place and I still have the card. Does it mean I can skip EAD once I arrive on a K-1 and start work - legally - the next day if I wish?

Hi,

NO you need an EAD or EAD stamp on your I-94.... SSN is not enough to legally work in the US... JFK is the only airport that gives out the EAD stamp, there are some land crossings from Canada that will give it too...

The EAD stamp is only valid for 90 days from the date of entry and then you are no longer Employment Authorized until you apply for and recieve the 1 year EAD that you will file for along with your AOS... so ther will be a gap where you will not be authorized to work....

Ta!!! I'm guessing that by asking for your SSN on the form it means it's out the window!!! Anyone else feel a bit of a slob lying around for months before you can work? We will get married about 2.5 months after we go there - I sincerely hope I can work before that!!!

The SSA does NOT grant work authorization, The Department of Homeland Security does. SO the SSN by itself is NOT work authorization, EAD, Green-Card or US Citizenship is what authorizes work.

You may want to read the requirements on form I-9.

One last NOTE: K-1 is not a work visa, it is a fiancee visa for entry to the USA and marriage, K-1 is "Work Auth" primarily to be able to get the SSN, some states are strict in their interpretation of a federal law that requires persons applying for a "license" to have SSN, this can cause a problem with marriage license if only one person has SSN and the other (the K-1 holder) does not.

Only marriage visas that guarantee work authorization upon entry to the USA are IR-1 and CR-1 Immigrant visas.

Correct, once SSA issues a number to a person, it is the persons SSN for life, all you need to do is keep SSA updated as to what your immigrations status is and any name changes.

Based on the above, you would be wise to set your expectations as if you will not work for at least six months after arrival. Even that isn't allowing for time to find a job. You may be able to line one up with a start date adjustable to when you receive EAD.

If you are extremely diligent and lucky, you could find some kind of work right away, if you get the EAD stamp on entry. It is then up to your employer whether they will keep you on while you wait for green card or the EAD you apply for after marriage.

Facts are cheap...knowing how to use them is precious...

Definitely consider the timing of your expected employment before you even apply for an EAD. We did, and it was a waste of money since David received his green card long before he got a job....

Definitely consider the timing of your expected employment before you even apply for an EAD. We did, and it was a waste of money since David received his green card long before he got a job....
OP is entering the country on a K-1 so should file for EAD with AOS not before filing AOS, filing for EAD with or after filing for AOS costs nothing when based on the pending I-485.

K-1 EAD by itself is a waste of $340, That type of EAD is a 90 day EAD that expires 90 days after entry on the K-1, and can take up to 90 days to get.

That's right... I'd forgotten that the rules changed/fees increased after we filed.... sorry to have mislead....
