Poverty Guideline for co-sponsor

TracyTN,

For an immigrant visa of AOS, where I-864 is involved, yes. But not necessarily for a K non-immigrant visa where I-864 is not used and a sponsor is not necessarily (although usually is) required.

A consular officer has a great deal of discretion in making the determination as to whether or not a K visa applicant meets the public charge provisions of the law, and the sponsor need not be the petitioner unless the CO decides he wants it that way.

Lets be clear on the terms, though. Your fiance would be the sponsor and needs to fill out an I 134 regardless; anyone else who files a I 134 would be considered a co sponsor.

The USC petitioner is always the sponsor by default, even if they need a co sponsor to make up the difference.

I thought the petitioner was, by default, the sponsor of the beneficiary for support purposes in a K1 visa process. Perhaps my understanding only extends to certain consulates (say, London)?

TracyTN,

London is the one consulate I can point to with a couple of specific examples of where the petitioner was not the sponsor and did not submit any financial information, someone else was the sponsor. (And to be clear, I'm not talking about the situations we've read about where no sponsor at all was required because the visa applicant had sufficient financial resources of their own.)

Most people attribute I-864 requirements to the K-visa situation, perhaps because they are uncomfortable with the subjectiveness and want well defined targets to shoot at. This issue of 'petitioner must be sponsor' is a requirement of immigration, not of non-immigrants including K non-immigrants. (Again, unless the consular officer using his discresionary authority wants it to be so.)
