Poverty Guideline for co-sponsor

Timeline

I know that, but by then my husband will prolly be able to co-sponsor for me alone. It's just that right now he can't, so we're using his father, but in a few months he's changing jobs and getting independent and all, so maybe by October or November (when we file for AOS) he'll be co-sponsor, or even his dad, but by then he won't be his dad's dependant anymore, so one less person in the household anyway.

I read that assets can be used, so that's a bit of a relief, but I'm trying with all I can to get by the interview without breaking a sweat, don't want to get nervous about the Rio's people asking me stuff about the affidavit, I want them to look and be happy with it. :P

Now I am getting scared of this Affidavit, 'cus first Luis said his father made at least 40,000 a year, so I wasn't worried at all, but yesterday he said it's actually 34,000, so we're barely above the guideline, and now with myself having to be included, and taxes, and I don't know what else I am getting nervous that we'll be told to have another co-sponsor, and I have no idea who we could get. :o

is that net or gross?

Which income line from the federal tax return is used for income determination?

The line for gross (total) income on IRS Forms 1040 (line 22 in 1996) and 1040A (line 14 in 1996) is used to determine income. The line for adjusted gross income is used for persons filing IRS Form 1040 EZ (line 4 in 1996).

Ok, will have my fiance know about this so he can sit with his father and check where they stand exactly. I must say it's really crappy having to depend on someone else, I wish we were better on this. We're just recent graduates, that's why all these worries.

This confused me a bit. So if his family has two people you have to do 125% of poverty line for THREE people because you would than include yourself, the fiance, as that other person right? So three total people for 125% for three people? right?

It's just me and my fiance so our family is 2 and 2 is about $16500 based on 125% of poverty line. i think....

Hummm... In this case, it's considered the CO-SPONSOR family, not you and your fiance! Your co-sponsor must do 125% of the poverty guideline for those ones that he supports (including himself) PLUS the beneficiary of the petition. So, one person more!

In my case, my father-in-law lives alone and supports only himself... So, he'll need to do 125% of the poverty guideline for two people! It would be to himself and ME (the beneficiary)...

Ok I get that. I never thought about this co-sponser stuff much. So as per "my father-in-law lives alone and supports only himself... So, he'll need to do 125% of the poverty guideline for two people." than if he doesn't make enough for 125% for two people does that mean he can't be used as a co-sponser? Don't they take in how much the petitioner makes as well? like they add up the amount co-sponser makes with how much petitioner makes?

So.. If my fiance say makes 14 thousand a year so he is 2.5 thousand under the poverty guide based on two people and doesnt have assets. Than we need a co-sponser. If co-sponser say makes the same amount than together it is over the poverty guide. is that ok?

No. The petitioner alone or the co-sponsor alone must meet the requirements. Sponsor and co-sponsor can´t add up their incomes to be the minimum required.

Lets be clear on the terms, though. Your fiance would be the sponsor and needs to fill out an I 134 regardless; anyone else who files a I 134 would be considered a co sponsor.

The USC petitioner is always the sponsor by default, even if they need a co sponsor to make up the difference.

Yep. I know my fiance will be my sponsor, but since he's graduating, and currently working at McD's, his father will be his co-sponsor.

Does it matter for the consulate that the fiance has nothing whatsoever, and that his father is actually the one supposedly supporting us both?

All the consulate cares is that you will not become a public charge upon arrival in the States. How that is acheived is up to you and your fiance (and cosponsor, in this case). The consulate just needs documentation to prove that you won't be a public charge.

Ok then. Luis told me today that his father made quite a bit more this past year, so we´ll be fine, especially since I found out assets add up to the guidelines, so we´re good to go, affidavit wise. I´ll prolly have more doubts about filling those forms out though. :P
