Its not about penalizing the legal resident vs an illegal. Its about penalizing a joint tax return as a basis for not cutting a stimulus check. And even that is inaccurate as we clearly defined that being legal, with an SSN, the stimulus check applies. So no issue for those that were confused by the language on the IRS calculator and were in the situation described previously.

What's confusing about the calculator? It says that if you have one ITIN on a joint return, you get zero payment. That's absolutely correct. It's correct according to all of the information on the IRS website. And the IRS is just doing what Congress told them to do. They didn't make the rules up.

I also checked the actual law as passed by Congress. It's available from Thomas.gov.

(h) Identification Number Requirement-

(1) IN GENERAL- No credit shall be allowed under subsection (a) to an eligible individual who does not include on the return of tax for the taxable year--

(A) such individual's valid identification number,

(B) in the case of a joint return, the valid identification number of such individual's spouse, and

© in the case of any qualifying child taken into account under subsection (b)(1)(B), the valid identification number of such qualifying child.

(2) VALID IDENTIFICATION NUMBER- For purposes of paragraph (1), the term `valid identification number' means a social security number issued to an individual by the Social Security Administration. Such term shall not include a TIN issued by the Internal Revenue Service.'.

Congress, wise or not, fairly or unfairly, decided that no rebate would go to someone who files a joint return unless the joint return contains a valid SSN for both spouses.

I don't know where it was that I was arguing about it. Maybe you can clarify?

As for Congress, well, that's their job.

I used that calculator and it worked for me. Don't use any comma when you enter the whole amount. Do not use any demical point either.

I-130 Timeline with USCIS:

It took 92 days for I-130 to get approved from the filing date

NVC Process of I-130:

It took 78 days to complete the NVC process

Interview Process at The U.S. Embassy

Interview took 223 days from the I-130 filing date. Immigrant Visa was issued right after the interview
