temp work permit w/k-1

Timeline

I've read that it is possible to get a temporary work permit w/the K-1 visa - is it worth it? Has anyone tried?

I also read that the immigration officers at JFK may grant incomming Fiance(e)'s a temp work permit upon request at the time that they come into the country. Has anyone tried this? does it work? is it worth trying to get Ollie routed to fly into JFK?

One more question... Ollie returns to the UK on March 22 (or there-abouts). Our K-1 was filed dec. 9th at the CA processing center. Are we fairly safe in scheduling his return on June 22? that would be 6+ months from filing to interview in UK.

At JFK indeed you get a temporary work visa that it's valid for only three months i think.Is it worth?No idea,i didn't had it.

Okay - for those who have gotten the temp. work permit @ JFK - How? did you ask the customs officer? what did you say? How long did it take? did they know what you were talking about, or was it a bit of a fight? do you have any recommendations for those who are expecting to do the same thing?

Hi

My husband received his temporary work authorization when he first came here on a K-1, he was automatically given the stamp for temp work visa for 3 months when he came into JFK. As to whether it is worth it in getting one, I would have to say no because most employers will not accept it. My husband has tried finding work using it and most companies have turned him away until he could get his permanent EAD. But who knows, maybe in your state employers may give him a chance with the temporary work visa until he receives the EAD.

The problem with getting the temp EAD with K1 is that unless you file for AOS the day after you arrive you will unlikely receive your 1 year EAD before your temp one runs out.... this would result in you having to give up your job...... until you had the new EAD in your hand....

Most employers will not accept the temp EAD because they know its only good for 90 days... from the day you enter the States...

I have heard of several people that have gotten the temp work permit...and they have not had to ask for it...it was automatically given at JFK...My fiance and I have had several discussions on this and he is definatly going to go through JFK and get it...he is from Jamaica and I am in Florida, but we are willing to send him up to JFK and then back down to Florida just to get it....I want him to at least be able to start to look for a job even if it is not a job that he will stay at for a long time....I cant imagine him coming here and not being able to at least look for a job for 2-3 months, he would be bored out of his mind, I have also already talk to some Tech. schools so he can attend classes...I am so scarred of him being bored sitting around with nothing to do while I work. He curently works 70+ hours a week on a cruise ship, and he would hate not having anything to do when he gets here...for a couple weeks he would be Ok doing nothing but 2-3 months would drive him crazy.

Just my thoughts on it.

Also I read one post (cannot remember were I read it) where the fiance had got the temp permit and it was about to expire so they went to the local office and explained the situation about the permit expiring and they had a job and had the paper work being procesed for the Perm. EAD...and the local immigration office extended the temp permit to allow time to recieve the perm. EAD.

wow ..... well I have never heard of the local office extending the EAD on a K1 visa that is technically expired... K1 is no longer valid as soon as you file for AOS... that is why the EAD is only valid for 90 days... the time you are allowed to take to file for AOS...

Good luck with getting it extended... you may want to check it out with your local office before he accepts a job and expects to get the temp EAD extended...

Thanks for all the feedback. We're in the heart of silicon valley here and Ollie will be wanting to work as a tech somewhere - the Temp. work permit will give him credibility as he starts working his contacts and writing interest letters. They may or may not hire him straight off w/the temp. permit - but at least they will have some assurance that he's in the system and the perm. work permit will (most likely) come thru. Also allows me to legally subcontract him :) and he won't be bord stiff for 2-4 months.

I got mine when I entered through JFK....didn't have to ask for it either, in fact I forgot all about it until I was outside the airport...then I checked in my passport and there it was!!!!

I needed mine because I wanted to work with my Hubby and I had to have my EAD, also I was very lucky and received my 1 year EAD card just over 60 days from entering the US....so it is not impossible to make it work.
