Ability to work and study after K-3

Hello all -

I have few questions and would appreciate your valuable advice. I recently sent I-130 and am planning to file I-129F once I get the NOA. These questions are regarding the K-3 visa after my spouse gets here.

1. If I understand correctly, we would need to file for EAD first. Only after the EAD is approved, we can apply for the SSN number. Is my understanding correct?

2. How long does it take to receive SSN after we apply for it?

3. My spouse is planning to study in the US after she comes here. If she starts studying soon after receiving her SSN, will she be considered and billed as an "International Student" or as a "Permanent Resident"? This is especially important for me because I would like to know if I would have to spend additional tution fees and whether she would be eligible for receiving financial aid.

4. Does the EAD approval still take approximately 3 months?

I can't answer any of the questions regarding the EAD, but as far as school is concerned, many institutions require residency in the state for a certain amount of time before you can be considered a resident for tuition purposes. I live in AZ and the schools here (ASU, University of Phoenix, etc) require residence of 1 year before you can qualify for resident tuition. Otherwise, before that date, you are considered a non-resident and pay more than double for tuition.

07/25/2008: NOA-1s for all 3 received

08/20/2008: Biometrics appointment

08/22/2008: Received RFE for Affadivit of Support and Medical

10/21/2008: Submitted I-865W in lieu of co-sponsor and medical info to NSC

11/14/2008: online case status not updated since filing of AOS in July 2008

01/20/2009: Received another RFE for Affadavit of Support Info

02/02/2009: Responded to RFE with brand new AOS based on 2008 tax return (if that doesn't shut them up, dunno what will)

02/19/2009: EAD card received in mail (no updates on Online Case Status ever made)

02/23/2009: AP received (again, no online updates)

02/26/2009: Received interview appointment letter for 4/6/09

04/06/2009: AOS approved for unconditional GC

04/21/2009: GC received

Once she arrives send in the application for EAD (you can do this in the same packet as AOS applications, or separately, your choice, read the guides for pros and cons). Typically it takes 90 days or less.

After she gets the EAD she can apply for SSN, when I applied for mine, it took about a week to receive it. YMMV. She can also get a driver's license once she has her SSN.

Residency actually depends on the college and how they determine your resident status. I checked around my area when I first moved here and some would have charged me international student tuitions because I didn't have a green card, others would have charged me resident tuitions because could prove I live here, full stop. Check around with each school.

If money is an issue, then include the EAD application with the AOS and the EAD fee will be included in the AOS fee ($1010). If money is not an issue, then send it separately, with an additional fee (don't remember what that is), and you get a 2 year EAD card.

yes all depend on the school!! My college based my residency on my wife!! She had been a VA resident for over a year, thus I got the resident rate vs the International rate, so phone around.

Canadians Visiting the USA while undergoing the visa process, my free advice:

1) Always tell the TRUTH. never lie to the POE officer

2) Be confident in ur replies

3) keep ur response short and to the point, don't tell ur life story!!

4) look the POE officer in the eye when speaking to them. They are looking for people lieing and have been trained to find them!

5) Pack light! No job resumes with you

6) Bring ties to Canada (letter from employer when ur expected back at work, lease, etc etc)

7) Always be polite, being rude isn't going to get ya anywhere, and could make things worse!!

8) Have a plan in case u do get denied (be polite) It wont harm ur visa application if ur denied,that is if ur polite and didn't lie! Refer to #1
