Pardon me?

She asked for ADVICE, and that's what I gave.

What should she do in her situation? Return home is the obvious choice in my eyes. I could have said 'HELL NO' are you going to get a green card, but decided to merely say what I did.

Just because YOU don't like MY answer doesn't make it uncalled for.

09/17/2021 - Interview - decision cannot be made

11/24/2021 - Denial letter, 30 days to appeal

12/24/2021 - Appeal sent back with I-912 waiver

12/24/2021 - Motion to terminate deportation proceedings from 2013 filed

You didn't offer advice. You offered a smartass answer to someone who genuinely needs help. Had your answer been a real thoughtful reply, you'd have phrased it much differently, much more compassionately. Of course going home is an option, the OP would have to be an idiot not to have thought of it. It goes without saying, especially the way you said it.

And you really need to consider what you're suggesting. The OP has been here for 3 years...this is their home now. What kind of life do you think they might have to go back to? No job, no home, no means of support. It might be that the OP decides to go home, or is even forced home. But that's a very personal decision, and they don't need you to point it out to them.

I get a kick out of people that think just because someone's marriage is breaking up that the alien should just jump on the next plane.

Why?

If something were to happen to my marriage, I would stay here. This is where I live and work now. My son likes it here so why would I move back?

Still waiting for our cards...Had to file I-90 as they sent them to the wrong address.

March 9th, 2010, Received GC that has been lost in the mail for 10 months. Still waiting for my son's that is lost as well.

Filed Waiver for my son's 10 year GC and it was approved. He finally received his GC after its been missing for 2 years.

Thanking God this is over for 10 years.

thank you alot for everythings, all anserw etc. thanks special for nice anserw..:) yeah, I come here for h2b visa.. I overstayed visa around 1, I got merried, but I never filled AOS, because always somethings what going on in my life.. money difficulties.. So, I was thiniking about back to home.. but I don't wanna so muich.. I live here 5 years..so.. I don't know wthat to do... my husband just left... ande good that his mother is with me. .. yeah... probbaly I have to take layer.. becuase I 360 it is not for me.. he didi noy abused me..

such great support. some of the replies i see on this site are great and helpful. others are just down right mean and vindicative. i agree and hope they never find themselves in that situation. i am a firm believer in what goes around comes around

If your marriage is no longer a viable marriage, then, yes, that is correct. You don't have a basis upon which to file. Unless there was some abuse by the USC to prevent the adjustment of status application from being filed. You mentioned money problems. Was it that your USC spouse couldn't or wouldn't pay for the filing costs? Or that he could not qualify as a sponsor?

Sad as it is this can be the nature of VJ, Since I joined in January 2004 I've seen so much of it and have been through the cticisms myself.. Having said that there are many people on here who are kind and very supportive.

Try and get to a Catholic charity which is pro bono.They may be able to help you and advise you on any options that you may have.
