I'm sorry to hear about your present status. It's good his mother is helping you.

Without knowing if you came to the US on a K1, K3,CR-1 visa, it's hard to say what you can do. I looked at your previous posts and didn't find much about your history in the US. I-360 maybe an option, however, I would suggest finding an immigratation lawyer to help you. You shouldn't be doing this by yourself as the USCIS is confusing if you are following their rules and have a simple case. You have overstayed your time to file for AOS, and need professional help if you are to stay in the US.
