Hi everyone

My marriage certificate took FOREVER to arrive (we got hitched in Hawaii) - it took 54 days :o from our wedding to receiving the certificate.

My I-94 expires at the beginning of April - the 4th.

I was under the impression that I would need the certificate for applying for a SSN (to prove I had married within the 90 day timeframe)

I applied for my SSN in person at my local office today (and WAS asked for my marriage cert) - all seemed fine according to the clerk as she entered everything into her computer - but I am now panicking after reading that the SSN may not be issued if the I-94 expires while they are verifying the documents.

Now I have the blasted certificate I am applying for AOS, Advance Parole and EAD - I aim to have everything submitted by the middle of next week (25th March) - whilst still within the 90 day timeframe - hopefully this will keep me "in staus" as it were.

Does anyone know if I will have any trouble with the SSN, or, out of curiousity, if there is a deadline for submitting AOS paperwork?

Firstly K-1 can apply for SSN anytime from entry to the USA until 76 days after entry, marriage cert is not needed to apply for SSN.

NOTE: K-1 is not a work visa, it is a fiancee visa for entry to the USA and marriage, K-1 is "Work Auth" primarily to be able to get the SSN, some states are strict in their interpretation of a federal law that requires persons applying for a "license" to have SSN, this can cause a problem with marriage license if only one person has SSN and the other (the K-1 holder) does not.

SSN is not required to file for AOS, you should file within the 90 days to maintain status.

our marriage certificate took sooo much time to get it ,my I-94 expired in december 2007 and at the end of that month i got the marriage certificate .I sent the AOS in march and i think there s not a problem if u dont file for AOS before the I-94 expires,they just say it s better to file earlier but like i said there s not any problem if u file late.and about the SSN i applied for it when i first came here ,i waited the week they said but nothing,i waitted for more than one month but still nothing.and when i went to apply again they said maybe they sent it and they got it back they give me just a paper shows my SSN and they said if u want the card u have to bring the EAD because when i went there for the 2nd time ,it was 10 days before the I-94 expired, and they say that if there s 14 days before the I-94 expires they dont give a SSN or card.your I-94 will expire in april 4 means 14 days from now,so you wont get a SSN ,as they will refuse and they will tell u bring the EAD.

That's good! Since you are filing EAD as well, once it's approved and you got the card in hand, you can use that in applying for SSN even though your AOS is still pending.

I just entered the US a few days ago and planned on getting married on June 7th. after reading here you don't have to file for AOS within the 90 day period I thought ok. however the officer in philadelphia told me I MUST get married and file before my i-94 expires on 17th June. and said I should probably change my plans to get married earlier or i would be illegal if i stay in us and don't file before the 90 days. so now i'm freaking out and will have to change wedding date so no delays with certificate :(

Did you read the link in post #2 above? The FAQ and every post has indicated yes to file AOS before I-94 expies, but a few weeks or a month after I-94 expires has not been a problem with anyone, USCIS tends to forgive any overstay (Out of Status) through marriage to a US Citizen. You just need to marry within the 90 days.

A quick update - despite applying for my SSN card with less than 14 days to I-94 expiry (and before filing for AOS) I received my card today! :)

I filed AOS within the 90 days so hopefully all will proceed well from here - fingers crossed :)
