Hi

I was planning for the future here and was thinking.

I promised my wife we would go to the Philippines this Christmas to visit her family. Hopefully she will be here on her K-3 shortly <Fingers crossed tightly>

Is it possible to finish the I-130 paperwork and plan to have her interview while we are there?

Why do you want a second visa (IR/CR-1) after you have had the first visa (K-3) approved?

well for one it would be less expensive and 2. she would enter the country as a citizen so we would not have to waste time on the AOs and pay the $1010.

In my mind it would be the $355 for the DS-230

right or wrong?

You will need to file for I-824 to get USCIS to move the I-130 case on to NVC for counselor processing of the I-130 into a CR-1 or IR-1 visa.

I-824 has a fee involved, and is unpredictable how long it will take to process, only person I have seen do the I-824 took about 6 months to get USCIS to move the I-130 on to NVC.

First off, she does not enter the country as a citizen but as a permanent resident (big difference) .... Second, the consulate does not retain the file as you will be carrying it back with you in the mystery brown envelope when she enters on the K-3. Not sure how you would get the I-130 back to the consulate for processing.

We could always adjust our travel plans to work around it

You need to add in the $340 for I-824,

The decision to go CR-1 OR K-3 needs to be made before filing the I-129F for the K-3

Don't for get the visa application fee of $400 (versus $131 for the "K")
Yep the $355+$45 which is the $400 you are talking about + $70 I-864 fee + another $340 to USCIS to move the I-130 on to NVC so

So this is $810 in fees to USCIS and NVC, then another Medical in Manila, and Vaccinations. So it is a toss up.

Those who file only the I-130 never pay the I-824 fee. Once you've filed both petitions, the opportuntity to obtain the CR1 visa requirese the I-824 fee unless USCIS violates their own current policy and forwards both petitions to NVC.

Facts are cheap...knowing how to use them is precious...
