I will make this fast. i married an illegal, he was abusive and mean forcing me to file his greencard or he'd leave, we talked it out i got pregnant he went to the interview. there i found out he that previously filed 2 times and failed for a greencard through lulac and something else. the interviewer didnt immediately give him his conditional greencard, we waited and finally he received it 4 months ago. here is my nightmare, he has thrown me out of my own apartment with my 2 month old child, so i now live with my parents and haas told me he only married me for his greencard and that he's going to find a woman he loves. he has all the immigration documents and never let me see it. i dont have the case number, or his a number. i am in a nightmare, my heart is broken , i had a child with a monster that used and abused me. i have recently closed our joint account, and currently canceling my lease. Monday i go down to my local nyc ins office. Any advice? do i have a chance to withdraw anything or remove his greencard. i will not be used in this way. Please someone tell me there is still hope in him losing his conditional greencard. Also he has refused to give me my marriage certificate or my child's birth certificate. this is too much, i am on antidepressants to get me through. :crying:

Oh god, what a mess. You should file for your divorce immediately. You can get your marriage certificate and your child's birth certificate from the city's they were originally issued. (it may cost a few dollars... to get my son's birth certificate was $8 in the town he was born)

You should make an info pass appointment to explain your situation. I'm not sure the green card will be revoked (or if it can be?)

Since he was living here illegally in the first place, he will probably go back to living here illegally.

You need to move forward and do what is best for yourself and your child.

Sept 2002... AOS (J1 to F1)

March 2003...AOS Approved

May 2003... Flew to SA. Reapplied for F1. RFE and Finally Approved. 2 year F1 visa in Passport.

Jan 21 2004... Married in Chicago

Aug 2004... Applied for AOS, Petition for spouse and EAD

Feb 2005... Joshua, our little cutie pie is born on SuperBowl Sunday

May 2005... EAD Approved

Dec 17 2005... AOS & Petition approved (2 year green-card received)

Aug 4 2007... Mailed in I-751 = $275 (remove conditions)

Aug 31 2007... Everything returned, filed too early, wrong fee

Sept 17 2007 Refiled to NSC

Sept 18 2007... Delivered by DHL to NSC

Oct 10 2007... Received at CSC

Oct 15 2007... Check cashed, transfered to CSC

Oct 15 2007... Received 1st notice with application number and 1 year extension. Notice Dated 9/19/07

Nov 1 2007... tried walk-in biometrics, refused

Nov 8 2007...Biometrics completed. Staff at Naperville ASC were great!

Nov 9 2007... Last touch

March 7 2008... Card production ordered!!!!!!!! 5 months, 2 weeks and 5 days

March 12 2008... Case Status: Approval notice sent

March 15 2008...Green card received in mail...so done with USCIS done for a few years!!!!!! :)

Yes YOU CAN ABSOLUTLY TURN HIS SORRY #### IN.

He only has a conditional card and that is for 2 years. AT anytime they can revoke his card. Absolutly tell the immigration office he said he married you for a card. They will investigate and revoke. If you have a voicemail or anything that is proof that always helps. Especially in NYC, they revoke them pretty quickly.

NOW FOR YOU...TAKE CARE OF YOURSELF GIRL!

You need to take your selfworth back. All these actions are NOT ABOUT YOU...THEY ARE ABOUT HIM AND HIS PATHETIC CHARACTER. You have to get that through your head and THEN your heart. I know how hard it is, but keep in mind that unfortunatly these type of people PREY on others. Learn from it, build your mind and heart back, and then LIVE again. You have a child and regardless of the wreckage the father made, the child is BLESSED to have a smart, amazing MOTHER that knows when to sit up and say NO MORE..I deserve better--WE deserve better. Build your strength and remember that all you need to do today is to LIVE for today. Tomorrow live for that day and so fourth. Eventually your days, turn into weeks, months, and years. LOOK AT YOUR BABY AND UNDERSTAND THAT OUT OF THIS MESS CAME A BELOVED LITTLE BLESSING!

You definitely need to file a police report, how can he kick you out of your own place with a baby? I understand the consequences that this might have for you but you can´t let him get away with anything like that... Plus two years from now he will have to remove conditions from his green card and he could claim that you mistreated him and that is why you are not together anymore and then he would be a Permanent Resident for 10 years... imagine that...

Sorry to hear the hell you are going through but I am sure your family will be there to support you, you know you haven´t done things exactly right, so move on and start by filing that police report.

He can only keep his 2 year green card and based on his history they may even revoke it, but I doubt it. He will definitely not get his 10 year green card. For now you need to go not only to Immigration to report him but the police as well. File for divorce and try to get as much child support as you can but based on this character's behavior you may not get anything from him at all.

Shouldn't the OP also pull the I-864 endorsement so she is not stuck with it come the removal of conditions time?

Unfortunately, once the AOS is approved, that is not an option.

Oh SNAP! No he didn't!!!

1. Start building a solid case by filing a police report IMMEDIATELY!!! - this will provide necessary documentation that will greatly help your case before immigration authorities and a divorce court. Without evidence (such as some kind of legal/law enforcement documentation), in the eyes of immigration, you'd have to overcome the presumption that you're not just another disgruntled spouse.

2. Since the marriage occured by deception and based solely on GC as opposed to love, file for an ANNULMENT as opposed to a divorce. This will help make the revocation of his GC a lot easier on the grounds that it was based on a marriage that shouldn't have been in the first place.

3. Contact the USCIS at 800-375-5283 and ICE (Immigration and Customs Enforcement) at 1-866-DHS-2-ICE (1-866-347-2423).

Technically, no. The I-864 is moot if marriage fraud could be established and/or the GC is revoked.

Yes, getting the marriage annuled and the green card revoked will definitely negate the I-864, but without the annulment/revocation or some other similar action by USCIS, the I-864 can not just be pulled. To the OP, I hope you are able to get USCIS on his case right away. Good luck.
