My fiancee/I-129 Beneficiary is a Philippines national, but has been living in China for 4 years. We know that she will need an NBI (National Bureau of Investigation) clearance from the Philippines for her Visa interview in Manila, but we are unsure if we will also be expected to provide some similar documentation/clearance from her time in China.

Does anyone have experience with needing to document clearance from countries other than the beneficiary's home country?

She will need a police clearance from all places she has lived since age 16... My fiance currently lives in a country other than her one of birth and she needs police certificates from both countries

Police Records

Generally available, reliable. Persons should apply for a certificate of no criminal record at the local Public Security Bureau (PSB) (or certain types of employers such as state owned enterprises), then make application to the notary office for a certificate based on the PSB document. Persons without a criminal record will be able to obtain a certificate to that effect. Certificates for individuals with one or more criminal convictions will list all convictions for which records still exist. The certificates purport to reflect all criminal convictions during residence in China. Police records are generally not available for the period prior to 1949. Certificates are available for those in the J-1, Z, and X categories. The GOC does not issue police records for temporary residents of China in L or F visa categories.

Police records also are not available for those who were in China in diplomatic status including those working for international organizations such as the United Nations. Notarial police certificates are based in part upon records from an individual's employer. If an employer refuses to release records, the notarial office is not able to issue a certificate. This is the case for persons sent abroad for education by the Chinese Government who fail to return to China.

According to a 1957 state council ruling that is still in force, the imposition of a re-education through labor (Lao Dong Jiao Yu) term does not result from a criminal conviction. Administrative organs, rather than courts, impose re-education through labor. It is important to distinguish re-education through labor from labor reform (Lao Dong Gai Zao), which is a sentence meted out for criminal offenses.

Yes she will need a Police cert from China along with a Notarial translation to English.

Manila has this:

OTHER COUNTRY POLICE CERTIFICATES. Applicants aged 16 years and older must also present police certificates from other countries where they have lived for six (6) months or more after reaching the age of 16. As with NBI clearances, foreign police certificates should be obtained

in any maiden names, aliases or nicknames ever used while in the country in question, including different spellings you have used of those names.

I would be asking the Chinese consulate or Embassy about how to obtain this record.

I am wondering how to get an NBI or police clearance from those countries since my fiance told me that those countries don't issue police clearances to foreign workers so i am worried! Are there any alternatives aside from these? We just sent our I-129F yesterday and he said i need it for my interview once we get approved. Any suggestions pls?? I would gladly appreciate response from u guys.. Thanks a lot and God bless! :)

I was just about to make a post like this thread yesterday!

My fiancee is a Filipina but works in Kuwait and worked in Bahrain before. Does anyone know about getting police documents in these countries? Would any police station do it? Do we need special forms? We just got NOA1 but she is supposed to go back to the Philippines within the next couple months to finish the process there. It would be great if we could take care of Bahrain and Kuwait while she is still in the region.

Police Records

Police records are available for persons resident in Kuwait. Individuals must be physically present in Kuwait and either be Kuwaiti citizens or hold a valid residence visa to apply for a police certificate. Police records are not available for periods of residence prior to May 1991, due to the destruction of these records during Iraq's invasion of Kuwait. Information on criminal activity, including police records, is not available from Kuwaiti embassies abroad. To obtain a police record, individuals must apply in person and provide fingerprints at the Ministry of Interior, General Department for Criminal Investigation. Police certificates generally take seven to ten days to process.

Hello, I'm PaulJen's fiance, and I'm hoping her post doesn't get lost since two more already arrived.

The situation- her permanent residence is Philippines, However, she was out of the country for 3 years touring between Singapore and Malaysia. Singapore says they will only give a police clearance for a stay longer than 6 months, and she was never there for that long at one time. Malaysia says one year, and she was never there for that long at one time. So- are we good?

Consulates have been known to aggregate multiple visits to the same country.... You need to ask the Consulate for final verification.

If these countries don't issue the certificates because her stays were not long enough, then I suggest that your fiancee get the respective Embassies to issue a letter indicating this so she could show the interview officer at the US Embassy that she is not eligible to apply for the certificates.

Adding this info regarding Police Clearance from China: it is true that Chinese PSB's will not issue police records for holders of L or F visas. I called the InfoLine service for the US Embassy in Manila for guidance ($18 fee - well worth it in my opinion - the agent was very helpful and patient). I was told that simply getting a statement from an PSB to the effect that police records are not available for L and F visa holders, and then showing that the beneficiary held such a category visa [copy/scans from passports with dates evident] would suffice :thumbs: .

As for the police clearance in Malaysia, it's called "Letter for Good Conduct", and the fee is RM20. You can either apply it in person at the Wisma Putra (bring along all the required documents, it can be done and you can collect it on the same day itself) or via mail (it takes about 14 days for the approved certification to mail to you). You may download the form on the Ministry of Foreign Affair's website, there is different version for foreigner and local, please take note. More information here, http://www.kln.gov.my/?m_id=1

On the other hand, the police clearance is called CNCC (Certificate of No Criminal Conviction) in Singapore, and the fee is about S$45. It takes 14 processing days. Same as Malaysia's, you can either apply it in person and via mail. More information here, http://www.spf.gov.sg/faqs/police_cncc.htm

I am Malaysian, but I've lived and worked in Singapore for 8 years, so I will have to get both police certifications for my K1, too. Since you are Filipino, I believe you know better I do about how/where to get the police clearance in Malina.

As for the police clearance in Malaysia, it's called "Letter for Good Conduct", and the fee is RM20. I am not sure if you are able to collect the certificate on the same day if you apply in person in Wisma Putra. I called them once asking about it and they said that they will send it to me and requested that I bring along a stamped return envelope. Hearing that and Wisma Putra is not totally near to me, I sent in my application and it took them 3 1/2 weeks for them to send me the certificate(though my application was a renewal application), all crumpled! So, you may want to check on that again.

By the way, that was in February/ March 2008.
