Hello Any one have an idea about income tax return 1040 (2006) My fiance filed his income tax return 1040 electronically ... my question is .. do he need to sign the income tax return ? I really need this for my interview on April 3 ... pls help me thank you..

Yes has to sign the 1040, and will also have to provide copies of any W2s and 1099 forms to back up the numbers in the 1040.

Transcripts OR Returns (1040/W2 AND/OR 1099)

One thing about I-134, the directions included with I-134 are very old, USCIS has no reason to update them since USCIS has no application for that form.

The consulates tend to treat the I-134 like a mini-I-864 as so prefer the same financial evidence as the I-864.

In our case this what the I-134 included.

  • I-134 signed and notarized.

  • SIMPLE Tax transcripts from the IRS for past 3 years, (Redundant for the (1040,W2,1099) but are free from the IRS http://www.irs.gov/faqs/faq1-6.html

  • Photo copy of IRS form 1040, and W2s for past 3 years (Not necessary if you provide the transcripts)

  • Letter from my employer stating annual salary, job responsibility, and that is full time, on company letterhead.

  • Photo copies of past month or so of pay stubs up to a few weeks before the interview.
My income was well above the povertyline so I did not include any asset data (LIKE BANK STATEMENTS or property values).

If your income exceeds 125% or (100% for military) of the povertyline when counting yourself, prospective immigrant and any dependents, then don't bother with assets (401K, Bank balance, Stocks etc..), it is just extra un-needed data to provide, the consular officer is most concerned with INCOME.

Thank you Yuandan, it's really great help for me ... im just curious because my fiance doesnt know anything he was just depending on his lawyer...actually i am new here.. i have lots of questions of my mind i couldn't find a solution ... His Lawyer Sent me a package ... and i recieve the I-797C NoA, I-29f Petition,

G-325A,Biographic Information, My Petitioner's Birth Certificate but its only a photo copied not notarized, a photo of Passport of my Fiance, a divorce decree from his wives, A Certification of Employement Where he is currently employed but the problem is theres no signature at the bottom its only :

Do you think the consul would accept this without signature?

And The last Part i recieved from the Lawyer of My Petitioner was the Affidavit of support I-134 on the second page of I-134 I only seen the signature of my fiance .....But the form I-134 prepared by his lawyer ..... there is no signature of the lawyer only he type the name and his address but no signature ....

No signatures are required on the Electronic returns - its electronic - if you start signing it - you will need paper - yes, they have electronic signature - but its just to verify who you are - like a password - they use AGI numbers and also have you assign a random 4 digit number as a verification but nothing on the return itself. I have filed electronically for several years and I just print a copy and thats all I sent for all of the process - 'No Signatures' were ever on the copies - I would suggest that if you are paranoid - you can write - 'no signature - filed electronically'. I didn't do that and had no questions asked during K1, AOS - and so far during removal of conditions. Good Luck

They wont have a problem with the lawyer not signing the I-134, Don't worry about this.
